Location Announcement of Nebraska Open Meetings Act:  A copy of the Nebraska Open Meetings Act is located on the wall at the rear of the Hearing Room.  Additionally, a copy of all written material to be discussed at today's open meeting is available from the County Clerk's staff at the front of the Hearing Room.  These materials can also be viewed on the County's web site at lancaster.ne.gov. 

 

Those wishing to speak on items specific to today's agenda are asked to do so when the item is called by the County Clerk.  Each speaker is limited to five (5) minutes.  Time limits may be extended or reasonably decreased at the discretion of the County Board Chair.

 

Those wishing to speak on items relating to other County business not on the agenda may speak during the public comment portion of the agenda.  Each speaker is limited to five (5) minutes.  These time limits may be extended or reasonably decreased at the discretion of the County Board Chair.  The public comment period will be limited to one (1) hour.

1)      MINUTES:

 

A.        Approval of the minutes of the Board of Commissioners regular meeting held on Tuesday, October 29, 2019. 

 

B.        Approval of the minutes of the Board of Commissioners One and Six-Year Road and Bridge Improvement Program meeting held on Tuesday, October 29, 2019. 

 

2)      CLAIMS:

 

A.        Approval of all claims processed through November 5, 2019. 

 

3)      CONSENT ITEMSThese are routine business items that are expected to be adopted without dissent.  Any individual item may be removed for special discussion and consideration by a Commissioner or by any member of the public without prior notice.  Unless there is an exception, these items will be approved as one with a single vote of the Board of Commissioners.  These items are approval of: 

 

A.        Grant contract with Boys & Girls Clubs of Lincoln/Lancaster County for the Keystone Leadership program (funded by the Nebraska Commission on Law Enforcement and Criminal Justice Juvenile Services Aid Grant.  The term of the grant contract is July 1, 2019 through June 30, 2020, in the amount of $8,000). B.        Amendment to the following grant contracts:

 

1.     C-18-0075 with Family Violence Council for Improved Community Response to Sexual Assault & Legal Advocacy Relating to Protection Orders & Immigrants program. (The term of the amendment is October 1, 2017 through September 30, 2019 for a decreased amount of $5,344.32). (C-19-0816)

2.     C-18-0109 with Voices of Hope for Improved Community Response to Sexual Assault & Legal Advocacy Relating to Protection Orders & Immigrants program. (The term of the amendment is October 1, 2017 through September 30, 2019 for an increased amount of $5,344.32). (C-19-0817)

 

C.        Third Grant Contract Addendum to C-19-0341 with Heartland Bike Share (BikeLNK). (The addendum extends the grant term completion date from October 31, 2019 to December 31, 2019.) (C-19-0824)

 

D.        Change Order #3 to County Contract C-19-0086 with Pavers, Inc., (to add Geogrid for an additional 5 working days to be added to the contract end date based off of the contractor schedule for an increase of $18,122). (Bid 19-029, Project 17-03, West Raymond Road - Replacement of County Bridge C-91) (C-19-0814)

 

E.        Change Order #1 to County Contract C-19-0764 with URETEK USA, Inc., (for overruns at locations A-151 and A-138 and an underrun at location N-149 for a net increase of $20,125.55). (Project 20-06; Abutment Stabilization of County Bridges N-149, A-151 and A-138) (C-19-0820)

 

F.         Utility Permits with no cost to the County for the following:

 

1.     No. 1890 allowing Windstream Nebraska to install a new fiber optic cable in the north right-of-way line of West Fletcher Avenue to support a new 5-G Tower.  (C-19-0815)

2.     No. 1894 allowing Windstream Nebraska to install primarily aerial lashing in county right-of-way in the Southwest 27th Street and West Van Dorn Street sector. (C-19-0819)

 

G.        Amendment to County Contract C-16-0698 with Sapp Bros Petroleum, Inc., for Annual Supply - Absorbents, Floor Dry.  (Quote No. 5498.  The amendment renews the contract from December 11, 2019 through December 10, 2020. The cost to the County is not to exceed $1,200.) (C-19-0818)

 

H.        Right-of-way contracts with the following:

 

1.     Bryce R. and Barbara L. Bentzinger, South 25th Street and Princeton Road, in the amount of $811. (C-19-0821)

2.     Wayne and Wanda F. Nielsen, Co-Trustees, North 70th Street and Mill Road, in the amount of $703. (C-19-0822)

3.     Karen L. Nielsen Schardt, North 70th Street and Mill Road, in the amount of $703. (C-19-0823)

 

I.         Received and placed on file the County Treasurer 2018 distress warrants.

 

4)      PUBLIC HEARINGS:

 

A.        Miscellaneous 19003 - vacation of a final plat on property generally located at 4180 North 148th Street (legally described as Lot 1 and Outlot A, McClellan Estates Addition located in the NW 1/4 of Section 10, Township 10 North, Range 8 East of the 6th Principal Meridian, Lancaster County, Nebraska). (See correlating item 5A)

 

5)      NEW BUSINESS:

 

A.        Resolution to vacate a portion of the plat of McClellan Estates Addition, generally located at 4180 North 148th Street, Lancaster County, Nebraska. (R-19-0077)

 

B.        Resolution authorizing Roma Amundson, the County Board Chairperson of Lancaster County, to sign the 2019 County Annual Certification of Program Compliance Form and rescinding County Resolution R-19-0076. (R-19-0078)

 

C.        Resolution in the matter of adopting benefits for Lancaster County employees in the unclassified service.  This resolution rescinds and replaces County Resolution No. R-15-0016. (R-19-0079)

7)      ANNOUNCEMENTS:

 

A.        The Lancaster County Board of Commissioners will hold a staff meeting on Thursday, November 7, 2019 at 8:30 a.m., in the Bill Luxford Studio (Room 113) of the County-City Building (555 S. 10th Street, Lincoln).

 

B.        The Lancaster County Board of Commissioners will hold a public hearing on Thursday, November 7, 2019, at 9:30 a.m., in Room 112 of the County-City Building (555 S. 10th Street, Lincoln, Nebraska) regarding County Special Permit No. 19035 (to allow for the construction of a commercial feedlot on property legally described as Lot 2, Benes Country Acres 1st Addition, and the E 1/2 of the NW 1/4 of Section 4, Township 12 North, Range 6, East of the 6th P.M., Lancaster County, Nebraska, generally located 1/4 mile east of NW 27th Street and West Ashland Road).

 

C.        A pubic sale will be held of surplus County real property on November 7, 2019 at 2:00 p.m., at the east door of the Justice & Law Enforcement Center (575 S. 10th Street, Lincoln, Nebraska).

 

D.        The Lancaster County Board of Commissioners will hold its next regular meeting on Tuesday, November 12, 2019 at 9:00 a.m., in Room 112 of the County-City Building (555 S. 10th Street, Lincoln).
