(19981719) (19981820) (19981774) (19981812) The Chair opened the public hearing and asked if anyone wished to testify in favor of the application. In response to a question asked by Campbell, Donald Carey, manager, stated the license before the Board would be the first license under his name. He explained he has managed and co-managed other facilities, but the licenses have not been under his name. Hudkins asked Carey if he had any violations while he was employed at other facilities. Carey responded no. Steinman stated a report from the Sheriff's Office indicates Carey was convicted of a "Driving While Intoxicated" (DWI) in 1995 and a reckless driving incident in 1987. Carey explained the "Driving While Intoxicated" incident occurred in 1994, but did not go to court until 1995. He stated he met all the requirements of the court and was released from probation early. He stated the 1987 incident was reduced from "Driving While Intoxicated" to reckless driving. Carey said he had made a judgmental error and he learned from his mistake. The Chair asked if anyone wished to testify in opposition or a neutral position. No one appeared and the hearing was closed. Brian Carstens, developer representing Richard Coupe, appeared and stated they had requested a three week delay. He explained the preliminary plat and community unit plan are being revised and that they will hold their testimony until those revised plans have been submitted. The Chair asked if anyone wished to testify in opposition. Dave Duckett, 9755 NW 96th Street, appeared and stated he lives approximately three-quarters of a mile away from the proposed site. He stated he is concerned with whether the Board is taking a close look at quality and quantity of water in area. Duckett stated there is very limited water in his area and indicated he had drilled three wells last year, however, they could not be used due to salt content. He stated he is also concerned about the quality of life and issues such as barking dogs, noise from motorcycles and minibikes. In response to a question asked by Heier, Duckett responded that he lives on an acreage consisting of ten acres. Hudkins asked Duckett about the depth of the well and when it was drilled. Duckett stated the well was drilled in August of 1997 at a depth of approximately 250 feet. He noted the depth of the three wells which were salty were at approximately 300 feet. Duckett stated he would have no objections to lot sizes of five acres unless it sets a precedence. He also stated he wouldn't have an issue with the development if there's a sufficient amount of water. Dave Ridder, 9300 West Bluff Road, appeared in opposition and stated he lives on 40 acres of land adjacent to the proposed site. He explained that neighboring property owners who signed a petition in opposition of the proposals have the following concerns: Quality and quantity of water Additional traffic He also stated most of the neighboring property owners are in favor of the 20 acre lots. Charlie Wilcox, 9700 NW 96th Street, appeared in opposition and indicated he lives across the road from Dave Duckett. He explained that he is a former member of the Malcolm Planning Commission and his concern is that by allowing a development on the one-mile fringe the village of Malcolm would have no control. Another concern to Wilcox is the limited quantity of water in the area. Kim Vanderkolk, 9800 West Bluff Road, appeared in opposition and stated he developed North Rim Estates. He explained he knew he was within Malcolm's jurisdiction and was given the option of developing four acre lots, however, he chose to stay with the ten acre lots. Campbell asked Vanderkolk if he owns additional land. Vanderkolk stated he lives at 9800 West Bluff Road on 17 acres of land and owns no other land other than his acreage and North Rim Estates. The Chair asked if anyone wished to testify in a neutral position. Mike DeKalb, Planning Department, appeared in a neutral position and stated water is a big issue. He stated the County Subdivision Regulations require a water report on quantity and quality. He explained a hydrologist reviewed approximately 15 wells in the immediate area and yields varied from 15 gallons a minute to over 200 gallons a minute and depth varied considerably from eight feet to 155 feet. DeKalb stated several wells had a high chlorine content. It was noted that the recommendation of the hydrologist was that the particular parcel of land could support the development with qualifiers. The Chair recessed until Tuesday, September 1, 1998 at 1:30 p.m. D. Amendment of the 1993 Lincoln-Lancaster County Air Pollution Control Program Regulations and Standards. (19981739) The Chair opened the public hearing and asked if anyone wished to testify in favor of the amendment. Marcia Willhite, Health Department, appeared and stated the amendment will update the air pollution control rules to incorporate new federal requirements. She explained the federal requirements already apply to businesses in the County and the City. MOTION: Hudkins moved and Campbell seconded approval.
