AGENDA for a Meeting of the Lancaster County Board of Commissioners to Be
Held Tuesday, April 28, 1998 at 1:30 p.m. in the County Commissioners
Hearing Room, First Floor, County-City Building.

1)  MINUTES: Approval of the minutes of the Board of Commissioners meeting
             held on Tuesday, April 21, 1998.  (1998946) (A copy of the

2)  CLAIMS: Approval of all claims processed through Tuesday,
            April 28, 1998.

3)  ITEMS OF PUBLIC PARTICIPATION:  It is the policy of the
    Lancaster County Board of Commissioners to accommodate the public to
    the greatest extent possible.  Therefore, this agenda has been prepared
    with items of greatest public interest at the beginning with more
    routine items toward the end as a courtesy to those who wish to speak
    with the County Board at this meeting.  If you are here to participate
    on an item and need special consideration because of a schedule

    Presentation of the County-City Volunteer of the Month Award to Gordon

    A Street Name Change to rename Prairie Lane as "Prairie Lake

       Class H (non-profit) liquor license for Hillcrest Country

        under the terms and conditions of the original provider's

7)  CONSENT ITEMS:  These are items of business before the
    Lancaster County Board of Commissioners which have been previously
    supplied to each Commissioner in writing, which are relatively
    routine and which are expected to be adopted without dissent.  Any
    individual item may be removed for special discussion and
    consideration by a Commissioner or by any member of the public without

       is broadcast live at 1:30 p.m. on Tuesdays will be re-broadcast
       at 6:30 p.m. on Cablevision Channel 5.

    MOTION: Hudkins moved and Campbell seconded approval of the minutes of
            April 21, 1998.  On call Campbell, Hudkins, Steinman, Svoboda

    The Chair agreed to move New Business Item 6A forward to
    follow the presentation of the Volunteer of the Month Award.

    The Volunteer of the Month Award was presented to Gordon
    Scholz for his services with Planning and Urban Development.

        State Board of Agriculture to hold the Frontier Harley "Spring Ride
        End of Event Banquet" with entertainment on Saturday, May 16, 1998

        Sharon Schrock, Nebraska State Board of Agriculture, appeared and
        explained that the owners of Frontier Harley have a club and each
        year they have a spring ride.  At the end of the ride they hold a
        banquet with entertainment and bar service.  She stated they want
        to use the outdoor area of Agricultural Hall to set up a beer garden
        area.

        Hudkins asked if there would be security to monitor the beer garden.

        Schrock stated the corporation security is a uniformed security
        company who works with the Board of Agriculture to stand by the
        bars and check i.d.'s.  She stated they can armband if they feel
        it's necessary.

    MOTION: Campbell moved and Tussing seconded approval.  On call Steinman,
            Svoboda, Tussing, Campbell and Hudkins voted aye.  Motion
            carried.

4)  PUBLIC HEARINGS:

    A Street Name Change to rename Prairie Lane as "Prairie Lake Drive",
    and to rename Prairie Lake Drive as "Prairie Lake Bay".  (Street Name

    The Chair opened the public hearing and asked if anyone wished to
    testify in favor, in opposition or in a neutral position of the street
    name change.

    MOTION: Tussing moved and Campbell seconded approval of Resolution
            1998975.  On call Hudkins, Steinman, Svoboda, Tussing and
            Campbell voted aye.  Motion carried.

5)  OLD BUSINESS:

    A.  An agreement with DocuPhase, Inc. for additional consulting services

    The Chair requested the agreement be withdrawn from the
    agenda due to a number of concerns.

    B. A resolution approving a corporate manager liquor license application
       from Shirley L. Beers in connection with a Class H (non-profit)

   MOTION: Campbell moved and Tussing seconded approval of Resolution
           1998976.  On call Tussing, Campbell, Hudkins, Steinman and

   C. A political subdivision tort claim filed against the Lincoln-Lancaster
      County Health Department by Thomas E. Zimmerman, on behalf of Brian

   Diane Staab, Deputy County Attorney, stated the claim had been
   investigated and recommended denial because there was no negligence
   found on the part of the County.

   MOTION: Hudkins moved and Tussing seconded to accept the County
           Attorney's recommendation and deny the claim.  On call Campbell,
           Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried.

6) RETURNING TO NEW BUSINESS:

   A.  An application for a Special Designated License from the Nebraska
       State Board of Agriculture to hold the Frontier Harley "Spring Ride
       End of Event Banquet" with entertainment on Saturday, May 16, 1998
       from 6 p.m. to 1 a.m. at Agricultural Hall in State Fair Park.

   B.  An agreement with the Nebraska Crime Commission on Law Enforcement
       and Criminal Justice for Lancaster County's participation in a
       statewide protection order registry, at no cost to the County.

   Bill Jarrett, Chief Deputy Sheriff, appeared and explained a statewide
   protection order registry is being implemented.  He stated any protection
   order filed in the State of Nebraska would be online and could be
   accessed through the Criminal Justice Information Services (CJIS) system.
   Jarrett stated it will also enable them to access information regarding
   gun registration permits.  Operation and maintenance of the system will
   be done by the Nebraska State Patrol.

   Steinman asked if the information would be available nationwide.

   Jarrett stated they hope it will be made available nationwide at some
   point.

   Steinman asked how many states are currently online.

   Mike Overton, Nebraska Crime Commission, appeared and explained that the
   Federal Bureau of Investigation is trying to perfect things at the
   federal level.  He added there are approximately seven states ready to
   contribute data.

   MOTION:  Tussing moved and Campbell seconded approval.  On call
           Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye.
           Motion carried.

           recommendation and deny the tort claim.  On call Tussing,
           Campbell, Hudkins, Steinman and Svoboda voted aye.

   J.  Setting of a public hearing for Tuesday, May 19, 1998 at 1:30 p.m. in
       the County Commissioners/City Council Chambers, Room 112, on the
       first floor of the County-City Building regarding proposed procedures

   chapel be sold with the condition that weddings and events scheduled

   MOTION: Svoboda moved and Campbell seconded approval of the Consent

9) OTHER BUSINESS:

   Campbell stated the County-City will be presented an award at the Mid-
   America Geographic Information System Symposium next Monday, May 4, 1998
   at the Cornhusker Hotel and that Larry Worrell, County Surveyor, will be
   representing the County.

   Campbell also requested that the agreement with DocuPhase, Inc. be
   reviewed when the County Board considers its budget. She stated Dave
   Kroeker, Budget & Fiscal Officer, wants to review where they budget the
   money and how they budget it. Campbell stated the Board should request
   Brian Pillard, Records and Information Management and Information
   Services to bring forth a recommendation as to how the issue should be
   addressed and added that the issue shouldn't be lost.

   MOTION: Tussing moved and Campbell seconded adjournment.  Svoboda,
           Tussing, Campbell, Hudkins and Steinman voted aye.  Motion

MINUTES Lancaster County Board of Equalization Commissioners Chambers First Floor, County-City Building Tuesday, April 28, 1998 1:30 p.m.
Commissioners Present: Linda Steinman, Chair Kathy Campbell Larry Hudkins Steve Svoboda Darlene Tussing Others Present: Kerry Eagan, Chief Administrative Officer Diane Staab, Deputy County Attorney Kandra Hahn, County Clerk 1) MINUTES: Approval of the minutes of the Board of Equalization meeting held on Tuesday, April 21, 1998. (1998945) (A copy of these minutes is on file in the Office of the Lancaster County Clerk.) MOTION: Hudkins moved and Campbell seconded approval of the minutes of April 21, 1998. On call Campbell, Hudkins, Steinman and Svoboda voted aye. Tussing abstained. Motion carried. 2) APPROVAL OF A MOTOR VEHICLE TAX EXEMPTION: The Catholic Bishop of Lincoln Food Bank of Lincoln, Inc. Grace Lutheran Church Campbell stated she would be voting on the item, however, she wanted to note that she is on the Food Bank Board of Directors. MOTION: Tussing moved and Svoboda seconded approval of motor vehicle tax exemptions for The Catholic Bishop of Lincoln, Food Bank of Lincoln, Inc. and Grace Lutheran Church. On call Hudkins, Steinman, Svoboda, Tussing and Campbell voted aye. Motion carried. 3) ADJOURNMENT: At the direction of the Chair the meeting was adjourned. Kandra Hahn Lancaster County Clerk
