1) MINUTES: Approval of the minutes of the Board of Commissioners meeting
held on Tuesday, March 31, 1998. (A copy of the minutes is on

MOTION: Hudkins moved and Tussing seconded approval of the minutes of
March 31, 1998. On call Campbell, Hudkins, Steinman, Svoboda
and Tussing voted aye. Motion carried.
2) CLAIMS: Approval of all claims processed through Tuesday, April 7, 1998.
MOTION: Tussing moved and Svoboda seconded approval. On call Hudkins,
Steinman, Svoboda, Tussing and Campbell voted aye. Motion
carried.
3) ITEMS OF PUBLIC PARTICIPATION:
Bob Van Valkenburg, 7921 Reno Road, appeared and distributed
documentation regarding property tax reduction and high quality
education.
4) PUBLIC HEARINGS:
Sale and fair market value of St. Francis Chapel located at 1145 South
Street.
The Chair opened the public hearing.
Kerry Eagan, Chief Administrative Officer, stated the purpose of the
hearing was to take evidence regarding the fair market value of the
property and evidence in favor of or against the sale.
Eagan also requested that any evidence introduced at the previous
hearing held on December 9, 1997 be made a part of the record.
John Layman, commercial appraiser, appeared and indicated St. Francis
Chapel was appraised as of June 24, 1997. He stated the market value on
the property on a fee simple interest is $176,000.
Layman stated that statues, altars, wooden pews and confessional would
be considered personal property. The oil paintings, statues and
stations of the cross which are mounted to the walls are considered part
of the historic features of the buildings.
He stated value on personal property would be as follows and should be
added to the value of the property:

Layman stated the personal property would need to be added into the
price of the chapel.
It was suggested by Layman that a clause be placed on the purchase
stipulating that the building be open to the public one day per week for
four hours, preferably on the weekend.
Campbell stated it has always been the intent of the Board to preserve
the chapel and asked if stipulations can be added to protect the
historical significance of the personal property to the chapel.
Ed Zimmer, Planning Department, stated the preservation ordinance in the
zoning code under which the chapel is made a landmark does not dictate a
certain result. If the chapel leaves the ownership of the County, a
measure of protection would be lost under the landmark ordinance. He
suggested stipulating, as a condition of the sale, any changes would
require a certificateof appropriateness.
Also suggested by Zimmer was to give the Preservation Commission some
responsibility for the public access question.
Diane Staab, Deputy County Attorney, requested the following be made a
part of the public record:
A copy of a lease agreement between the County and St. Francis Chapel,
effective through September, 1998 (Exhibit B)
A copy of the Landmark Designation and Preservation Guidelines
applicable to the chapel (Exhibit C)
A list of conditions to be a part of the sale of the chapel (Exhibit D)
Kent Radke, attorney representing an interested buyer, appeared and said
he had no objection to the appraisal offered by Mr. Layman, but said that
he feels it is imperative that the artwork and the chapel be sold as one.
Radke also assured the Board that they would respect the integrity of the
building and achieve the Board's goal to preserve the chapel. Their
expectation would be to use the chapel for its intended purpose. He also
indicated there would be no objection to having the chapel open on a
Saturday or Sunday for up to four hours.
The buyer's only concern, Radke stated, is that anyone coming into the
chapel respect the decorum and integrity of its intended use and any
tours or groups who want to view the chapel make arrangements through
the appropriate channels.
An inspection of the structure has been completed and it was recommended
that the roof was in need of serious repair. Radke stated if the sale
of the chapel occurs in 60 days, the new owner would take possession in
June and would begin some renovations immediately, however, there is a
tenant who has legal obligation under lease through September, 1998.
Potential bookings that have been made past the end of September are
another concern. Radke encouraged the Board to make a strong statement
that when the lease ends the current tenants cease use of the chapel.
Discussion of the limited number of parking spaces followed, with Layman
indicating there is the possibility of an additional 30 spaces to the
east of the chapel, however, the green space would be forfeited.
In response to a question from Campbell, Radke said the inspection also
showed that the chapel will need some plumbing and electrical work, as
well as some work to the foundation, however, the potential buyer has
the full and complete backing of the Diocese of Lincoln.
Anne Senkbiel, St. Francis Chapel Foundation, appeared and stated
weddings are scheduled on every Saturday through December, 1998 and there
is one wedding scheduled for May, 1999. She added that no concerts or
tours are scheduled after September. Senkbiel stated some of the
weddings were scheduled two years ago.
In response to a question from Hudkins, Senkbiel stated those
weddings scheduled have made a 50 dollar deposit.
Kathy McKillup, Preservation Action of Lincoln and Nebraska Preservation
Network, appeared and encouraged public access for the St. Francis
Chapel. She stated St. Francis Chapel is the only chapel in Lincoln
solely used for community use.
Campbell stated she felt strongly that the primary objective of the Board
is to preserve the chapel and to save it. She stated that the community
use of the chapel has been a very nice auxiliary part of it, however,
the first objective has been to preserve the chapel.
The Chair asked if anyone else wished to testify.
No one appeared and the Chair closed the public hearing.
Staab stated if the Board does decide to sell the chapel, the Board needs
to set the sale date and sell within 60 days of the hearing. She
suggested they further discuss the issue at a Thursday meeting.
Campbell requested Ed Zimmer attend the meeting.
5) OLD BUSINESS:

The Clerk stated a letter had been received from J. Michael Rierden,
attorney representing the applicant, requesting the Change of Zone be

It was the consensus of the Board to place Change of Zone 165 on pending
for a six month period to October 6, 1998.

addressed their concerns and there would be no objections to the
application.
MOTION: Tussing moved and Campbell seconded approval with the
conditions as outlined by the Sheriff and County Engineer. On
call Steinman, Svoboda, Tussing, Campbell and Hudkins voted

carried.
4) DENIAL OF A MOTOR VEHICLE TAX EXEMPTION:
Fellowship Baptist Church
MOTION: Tussing moved and Svoboda seconded to accept the County
Treasurer's recommendation and deny the motor vehicle tax
exemption for Fellowship Baptist Church because the exemption
was not timely filed per State of Nebraska, Property Tax
Division Directive 97-2. On call Svoboda, Tussing, Campbell,
Hudkins and Steinman voted aye. Motion carried.
