Peter Katt, attorney representing the applicant, appeared and indicated Duane Hartman, shareholder and director of DLH, Inc., was unable to appear before the Board. He stated the facility had held a liquor license in the past, however, the previous owner had filed for bankruptcy last fall. Katt stated Mr. Hartman would like to continue the business and continue to have a liquor license available for the sand volleyball courts. In response to a question asked by Steinman, Katt stated that operating a juice bar was an option, however, Mr. Hartman felt that would not be a good idea. The Chair asked if anyone wished to testify in opposition or in a neutral position. No one appeared and the Chair closed the public hearing. Action to be taken Tuesday, April 7, 1998. 5) NEW BUSINESS: A. An agreement with BI Incorporated to purchase two electronic monitors, in the total amount of $1,400, for Juvenile Probation. (98-717) Kerry Eagan, Chief Administrative Officer, stated BI Incorporated is offering the County a $500 monitoring service credit if the agreement is signed by March 31, 1998. He noted faxed copies of the agreement and equipment schedule will need to be sent to Chicago and Boulder. MOTION: Campbell moved and Tussing seconded approval of the agreement and equipment schedule, including a $500 monitoring service credit. On call Svoboda, Tussing, Campbell, Hudkins and Steinman voted aye. Motion carried. B. He asked for general consensus of the Board to allow him to hire new law clerks at competitive rates of approximately $11 per hour. Campbell stated she would like to see the County Attorney's Office stay competitive and feels that starting at approximately $11 per hour would be fair. MOTION: Tussing moved and Hudkins seconded approval of the step increases and that new law clerks hired be paid an hourly rate of approximately $11. The Chair recessed the Board of Equalization until 2:30 when it was reconvened. 4) NOTICE OF VALUATION CHANGE: Rosburg Enterprises Robin Hendricksen, Chief Deputy County Assessor, stated on January 1, 1998 changes were made to Statute 77-1507 which no longer allows county assessors to change valuations for omitted or undervalued property for prior years. Hendricksen recommended the notice of valuation change be rescinded for Rosburg Enterprises for the 1997 tax year. MOTION: Campbell moved and Tussing seconded to rescind the notice of valuation change for the 1997 tax year for Rosburg Enterprises. On call Campbell, Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried. 5) APPROVAL OF 1998 451A TAX EXEMPTION APPLICATIONS ON REAL PROPERTY PER EXHIBIT B (98-655) MOTION: Hudkins moved and Campbell seconded approval of the 1998 451A tax exemption applications on real property for the Indian Center, Inc., Saint Mary's Catholic Church and Saint Paul United Methodist Church. On call Hudkins, Steinman, Svoboda, Tussing and Campbell voted aye. Motion carried. 6) APPROVAL OF 1998 451 TAX EXEMPTION APPLICATIONS ON PERSONAL AND REAL PROPERTY PER EXHIBIT C (98-652) MOTION: Campbell moved and Tussing seconded approval of the 1998 451 tax exemption applications on personal and real property for Bryan Memorial dba/Lincoln General (3 exemptions) and Nebraska Wesleyan University. On call Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye. Motion carried. 7) APPROVAL OF 1998 451A TAX EXEMPTION APPLICATIONS WITH LATE FILING ON PERSONAL AND REAL PROPERTY PER EXHIBIT D (98-651) Beta Alpha House Association Jessie Waller, Beta Alpha House Association, appeared and explained the notice was sent to the address of a person who was no longer on the board. In response to a question asked by Waller, Hendricksen stated the penalty would be $100 and would not be due until April 1, 1999. Free Methodist Church of North America Steve Gray, Free Methodist Church of North America, appeared and stated he had never received anything regarding the exemption. MOTION: Hudkins moved and Tussing seconded approval of 1998 451A tax exemption applications with late filing penalty on personal and real property for Beta Alpha House Association, Downtown Lincoln Foundation, Free Methodist Church of North America, Glad Tidings Assembly of God, Malone Community Center Housing Corp. (2 exemptions), Near South Neighborhood Association, North American Islamic Trust, Inc., Saint James United Methodist Church, St. John of Kronstadt Eastern Orthodox Church, United States Dressage Federation and Women in Community Service, Inc. On call Svoboda, Tussing, Campbell, Hudkins and Steinman voted aye. On call Hudkins, Steinman, Svoboda, Tussing and Campbell voted aye. Motion carried. 11) 1998 DISAPPROVED 451A TAX EXEMPTION APPLICATIONS ON REAL PROPERTY PER EXHIBIT H (98-649) MOTION: Campbell moved and Tussing seconded approval of the 1998 disapproved 451A tax exemption applications on real property for Bryan Memorial Hospital and Lincoln Habitat for Humanity (2 exemptions). On call Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye. Motion carried. 12) 1998 DISAPPROVED 451 TAX EXEMPTION APPLICATIONS ON REAL PROPERTY PER EXHIBIT I (98-650) Frederic Ozanam Building Ted Patterson, Frederic Ozanam Building, appeared and explained they intend to use the lot as a parking area. He stated the lot is level, however, they intend to improve the area to be more suitable for parking. Hendricksen stated if improvements were made to the lot prior to August 1st they can reapply for the exemption. Hickman Presbyterian Church Charles Noren, attorney representing Hickman Presbyterian Church, appeared and explained the parcel was purchased on August 19, 1997 for the purpose of expanding their educational wing and for a parking lot, however, with the weather and other factors no work has been completed. Hendricksen reiterated that if improvements are made prior to August 1st the church may reapply for exemption. Berean Fundamental Church/Lincoln Lynn Zabel, Berean Fundamental Church/Lincoln, appeared and stated they have spent approximately $200,000 on site work and building and design fees for the property. He stated contracts are signed for another $400,000 in design work and over $2,000,000 for building construction. Hendricksen asked if a building permit had been issued. Zabel responded no. Campbell suggested placing the exemption on pending for 30 days. MOTION: Campbell moved and Tussing seconded approval of the 1998 disapproved 451 tax exemption applications for Christ's Place Church, Frederic Ozanam Building and Hickman Presbyterian Church (USA) and place on pending Exemption Numbers 25E and 25D, Berean Fundamental Church/Lincoln for 30 days.
