6)  CONSENT ITEMS: These are items of business before the Lancaster
    County Board of Commissioners which have been previously supplied to
    each Commissioner in writing, which are relatively routine and which
    are expected to be adopted without dissent.  Any individual item may
    be removed for special discussion and consideration by a Commissioner

    A.  The Lancaster County Board of Commissioners will not hold a
	meeting on Thursday, February 12, 1998 instead it will be held
	on Tuesday, February 10, 1998 from 8 a.m. to 10 a.m. in the
	Mayor's Conference Room located on the second floor of the new
	County-City Building.

    B.  Public hearings will be held on Tuesday, March 3, 1998 at 1:30
	p.m. in the Commissioners Hearing Room located on the first
	floor of the new County-City Building for the following:

        1.  A vacation of a portion of Wittstruck Road in conjunction
	    with the construction of the Upper Little Nemaha Natural
	    Resource District Dam Number 21.  (98-201)

Board of Equalization 2:30 p.m. 4) NOTICE OF VALUATION CHANGE FOR OMITTED OR UNDERVALUED PROPERTY FOR MICHAEL H TOWNE: (98-131) The County Assessor recommended setting a value of $51,800 for 1997. MOTION: Tussing moved and Hudkins seconded to approve the County Assessor's recommendation and set the value for 1997 at $51,800 for Michael H. Towne. On call Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried. 5) APPEAL REGARDING A HOMESTEAD EXEMPTION FILED BY PAUL GALTER ON BEHALF OF ETHEL E CHRISTOPHERSON: (98-187) The Assessor recommended denial of the homestead exemption. MOTION: Hudkins moved and Tussing seconded to accept the County Assessor's recommendation and deny the homestead exemption. On call Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried. 6) APPEAL OF PENALTY ON PERSONAL PROPERTY FILED BY MARY E FURNAS: (98-141) The Assessor explained Ms. Furnas had filed a return for 1997, however, the Assessor's Office filed a "Failure to File" for 1996. He said it is customary to assess a 50 percent penalty on a failure to file. Agena stated there is a 30 day period after the taxpayer has received notice to file an appeal. The appeal was dated November 22, 1997, which was within the 30 day period, however, it was not received by the Assessor's Office until January 21, 1998. The Assessor recommended assessing a 50 percent penalty. MOTION: Hudkins moved and Tussing seconded to accept the County Assessor's recommendation and assess a 50 percent penalty on personal property. On call Steinman, Svoboda, Tussing and Hudkins voted aye. Motion carried. 7) 1997 EXEMPTION ON REAL ESTATE FOR PINE LAKE HEIGHTS CONGREGATION OF JEHOVAH'S WITNESSES, INC.: (97-591) The Assessor stated the County Attorney's Office had recommended that there be no exemption for 1997. He also stated the exemption for 1996 would have been denied because of the name change and also due to the fact that the only construction taking place was a storage building. MOTION: Tussing moved and Hudkins seconded to accept the County Attorney's recommendation and deny the exemption on real estate for Pine Lake Heights Congregation of Jehovah's Witnesses, Inc. for 1997. (98-24) (98-185) The Chair opened the public hearing and asked if anyone wished to speak in favor, opposition or in a neutral position regarding the vacation request. Ken Sherwood, County Engineering Department, appeared and indicated his office is proposing a bridge replacement project near Southwest 58th Street and West Panama Road. He noted it was found that the existing county road does not lie within the County's right-of-way. To correct the problem they are requesting the vacation of all of the existing right-of-way. Sherwood further stated all abutting property owners had been contacted and the Engineering Department has acquired deeds for right-of-way from those owners. The Chair closed the public hearing and noted that no action will be taken until Tuesday, February 17, 1998. B. A special permit, requested by Randy Kumpost, to operate a veterinary clinic in an existing barn on property located at Southwest 42nd Street and West Wittstruck Road in Lancaster County, Nebraska. (County Special Permit Number 155) (98-132) (98-260) The Chair opened the public hearing and asked if anyone would like to speak in favor of the special permit. Mike DeKalb, Planning Department, appeared in a neutral position and stated there had been an amendment to condition two from "The clinic shall be limited to horses and small animals. No cattle or hogs shall be treated on this site." to "The clinic shall be limited to horses and small animals. No more than three cattle or hogs shall be treated on this site at any one time". (Exhibit A) Randy Kumpost, applicant, appeared and indicated he was in agreement with the amendment to condition two. The Chair asked if anyone wished to testify in opposition or in a neutral position. No one appeared and the public hearing was closed. MOTION: Tussing moved and Hudkins seconded approval of the Special Permit with the amendment to condition two. On call Steinman, Svoboda, Tussing and Hudkins voted aye. Motion carried. C. Robert Pickel, applicant, appeared and stated he had worked for Gas 'N Shop for 12 years. Ten of those years have been in a managerial position. The Chair asked if anyone wished to testify in opposition or in a neutral position. No one appeared and the public hearing was closed. It was noted for the record that action will be taken on Tuesday, February 17, 1998. D. An application for a Class E (Beer Off Sale Only) and a Class K (Wine Off Sale Only) for Nebraska Retail Ventures LLC located at 10000 South 158th Street, Bennet, Lancaster County, Nebraska. Terry Williams, Operations Manager for Nebraska Retail Ventures LLC, appeared and was administered the oath. Williams pointed out to the Board that the business is located in "Industrial" zoning and not "Agricultural" as indicated in the documentation provided to the Board. The Chair asked if anyone wished to testify in opposition or in a neutral position. No one appeared and the public hearing was closed. In response to a question asked by Hudkins, Don Thomas, County Engineer, stated dustless surfaced roads are the equivalent of blacktop. ROLL CALL: Hudkins, Steinman, Svoboda and Tussing voted aye. (98-533) Diane Staab, Deputy County Attorney, recommended the claim be denied because no evidence was found that the County was negligent. MOTION: Tussing moved and Hudkins seconded to accept the recommendation from the County Attorney's Office to deny the claim. On call Svoboda, Tussing, Hudkins and Steinman voted aye. Motion carried. G. A political subdivision tort claim filed by Dorothy A. Walker on behalf of Lanny J. Breneman filed against the Corrections Department for injuries. (98-259) Staab recommended the claim be denied because no evidence was found that the County was negligent. It was noted by Staab that medical bills were paid by the County for treatment which the claimant received until the time that the claimant was no longer in the County's custody. MOTION: Hudkins moved and Tussing seconded to accept the recommendation of the County Attorney's Office and deny the claim. On call Svoboda, Tussing, Hudkins and Steinman voted aye. Motion carried.
