A Special Permit, requested by SBA, Inc., for authority to construct and operate a 300 foot wireless communications broad- cast tower on property located north of 162nd Street and Alvo Road in Lancaster County, Nebraska. (County Special Permit Number 152) (97-469) (97-519) (R-5606) The Chair opened the public hearing and asked if anyone wished to testify in favor of the special permit. Lance Bleyhl appeared on behalf of SBA, Inc. He explained they are building a 300 foot telecommunications tower for Nextel Communications, Incorporated. An enhanced specialized mobile radio (ESMR) system is being constructed which is the reason for the increased height. Bleyhl noted the tower is being built to accommodate five wireless carriers and that they would be able to keep the proliferation of towers down. In response to a question from Hudkins, Bleyhl indicated he had made a search for existing towers, however, only one structure belonging to Cellular One met the 300 foot height requirement. He explained that Cellular One was concerned with the structural stability of the tower due to existing equipment and the possible addition of equipment on the structure. In response to a question from Steinman, Bleyhl stated they have not received the Federal Aviation Administration's (FAA) ruling regarding lighting for the tower. He stated they would follow the lowest recommendation of the FAA. Campbell asked Bleyhl if he understood that the motion approved by the Planning Commission was that no strobe lights be used. Bleyhl said if the FAA required them to use a strobe lighting system they would need to go through the special permit process again. Campbell asked if Aliant would relocate to their tower. Bleyhl said discussion has taken place with Aliant and Sprint on the issue. He said they would definitely have room for them on the tower, but at the present time no agreement has been reached. Ray Neujahr, Route 3, Lincoln, Nebraska, appeared and said he is in favor of the special permit because of the money they bring in. He asked the County Board why they canceled a hearing for a Sprint tower approximately one year ago. Mike DeKalb, Planning Department, appeared and explained Sprint had made an application for a tower on Mr. Neujahr's property, however, they withdrew the application and co-located on a tower with Aliant prior to hearing before the Planning Commission. The Chair asked if anyone wished to testify in opposition. Donald Bley, 7900 North 162nd Street, appeared in opposition and stated he lives one-quarter of a mile south of the proposed tower site. He added there is currently a 300 foot tower one-quarter of a mile south of his residence and a 200 foot tower one-quarter of a mile north. Bley stated he believes there should be alternative locations instead of erecting three towers in one area. Bley submitted a fact sheet from the Federal Communications Commission into the record (Exhibit A) and referred to page three, section four regarding the use of Federal or State government property. Also referred to was page nine, section six regarding the sharing of tower structures. Bley stated he felt some guidelines have not been followed and urged the Board to review the all information provided. Also submitted was a copy of Bley's testimony (Exhibit B). Steinman stated some of the guidelines are instituted into the special permit process. The Chair asked if anyone wished to speak in a neutral position. Tussing asked if she was correct in her understanding that the County Board cannot deny access. DeKalb stated reasonable conditions may be applied and co-location can be required, however, the Board cannot prohibit the ability of a franchised licensee to locate within their area of jurisdiction. Steinman asked about Bley's contention that they could use already existing State right-of-way for building towers. DeKalb responded that if the State wished to construct a tower on State land the County would have no authority. In response to a question asked by Tussing, DeKalb responded that he thought there was a two year time frame that package frequencies have to built and running. Bleyhl responded that the initial offering took place two years ago and licensees were given a time period of three to four years to get their systems running. In addition, he said, a year after that another option was given which provided four additional licenses in the spectrum. Bleyhl said with the onset of digital television more options would be taking place in the future. Campbell asked if SBA co-located in other areas. Bleyhl responded that SBA had co-located on five sites. In response to a question asked by Campbell, DeKalb said Ed Zimmer and Jennifer Dam, Planning Department, are studying the issue and intend to prepare a report. He also stated if one tower is constructed which can handle five or more co-locates it would resolve the question of whether they are constructed separately or all packaged together. The Chair closed the public hearing. MOTION: Campbell moved and Tussing seconded approval of Special Permit Number 152 with the condition stipulated by the Planning Commission that there be no strobe lights. On call Steinman, Tussing, Campbell and Hudkins voted aye. Svoboda was absent. Motion carried. B. Change of Zone, from AG Agricultural to AGR Agricultural Residential, requested by Arnold Bentzinger, on property located north and west of the corner of Southwest 14th Street and Wittstruck Road in Lancaster County, Nebraska. (County Change of Zone Number 177) (97-468) (97-518) (R-5607) The Chair opened the public hearing and asked if anyone wished to testify in favor of the change of zone. James Buhrmann, representing the applicant, stated they are located on Southwest 14th Street which has been on the One-and-Six-Year paving agenda for 20 years. He said it has not been paved because there is an insufficient traffic count. Buhrmann said they are willing to work with any kind of restrictions deemed necessary by the County Board. Steinman requested a letter of opposition from Charlene Brandt be entered into the record (Exhibit C) and asked if anyone wished to testify in opposition. Stanley Brandt, Martell, Nebraska, appeared and explained their land is located in the southwest corner of the same section of land. He said he felt there was no need for this type of development and that the wiring was 60 years old. Brandt also stated he would like to keep the area rural agriculture. Joanne Bohmont, Lancaster County resident, appeared and indicated she lives a mile and a quarter west of the development. She said she felt the following issues should be considered: The fire and emergency system is not large enough to handle any more developments. There are no concrete plans as to location of houses or what type of sewer system will be used. The Chair asked if anyone wished to speak in a neutral position. Ed Griggs, Martell, Nebraska, appeared and asked if Change of Zone Number 177 would effect what happens in Martell. DeKalb explained Change of Zone Number 177 is strictly County, however, there is another change of zone request which has been filed for in the Planning Department which is adjacent to the north side of Martell. He noted that a corner of the zoning change was in Sprague's jurisdiction with the balance of it being in Lancaster County's jurisdiction. DeKalb said the proposal is tentatively scheduled to be heard by the Planning Commission on January 28, 1998. The Chair asked if anyone else wished to testify. No one appeared and the hearing was closed. MOTION: Campbell moved and Hudkins seconded to deny Change of Zone Number 177. On call Tussing, Campbell, Hudkins and Steinman voted aye. Svoboda was absent. Motion carried. 5) OLD BUSINESS: A political subdivision tort claim for $100,000 filed against the Health Department by Brian and Kelli Hughes for damages. (97-327) Tom Zimmerman, attorney representing Brian and Kelli Hughes, appeared and requested the following be submitted into the record (Exhibit D): Letter to Tom Christopherson, Department of Health, from Brian Hughes. Water well registration form from the Department of Water Resources Initial report from November, 1996, including findings and a diagram, prepared from Christopherson Three reports from Christopherson prepared after the initial report Information from the County Health Department's file regarding the well Explanation of results of chemical water analysis Summary of special damages Zimmerman explained that there was a domestic water well on the property which the Lincoln-Lancaster County Health Department determined to be deficient. He said a new well had to be sunk and the old one was to be capped, however, the new well was located too close to two sources of bacteria. Zimmerman stated the County Health Department approved the location of the well which was the reason the Hughes' bought the property, however, for the past year they have had to haul water in for their use due to contamination. Brian Hughes, claimant, appeared and gave a brief background regarding the claim. He said there were four areas of concern: The well was placed too close to the corral. The well was placed too close to an open drainage ditch. The well was placed in the well house where the old well was located. Open sewage. Another area of concern was the unregistered well. Steinman asked if there was an outside reason for the Health Department to know that the site was not a proper location for the well. Zimmerman stated that on a form which the Health Department signed off on it is noted that the well is 50 feet from manure. He said he felt it was clear that the Health Department knew of the potential sources of the contamination. Hughes stated he performed a nitrate test on October 16, 1997. The nitrate reading came back less than 0.1 percent. The chloroform purity test read 94 per 100 milliliters. Hudkins asked what the acceptable range was on the chloroform test. Hughes responded it should be zero. Diane Staab, Deputy County Attorney, asked Hughes if she was correct in understanding that before they bought the house tests were conducted by the Health Department which were negative. Hughes stated that was correct. Staab recommended the claim be referred to the County Attorney's Office and Risk Management for further investigation. MOTION: Campbell moved and Hudkins seconded to refer the claim to the County Attorney's Office and Risk Management for further review with a report back to the County Board.
