AGENDA For A Meeting Of The Lancaster County Board Of Commissioners To Be Held Tuesday, November 4, 1997 At 1:30 p.m. In The County Commissioners Hearing Room, First Floor, County-city Building.

1) MINUTES:   Approval of the minutes of the Board of Commissioners meeting
	      held on Tuesday, October 28, 1997.
          (Copies of these minutes are on file in the Office of

2) CLAIMS:    Approval of all claims processed through Tuesday,

3) ITEMS OF PUBLIC PARTICIPATION:  It is the policy of
   the Lancaster County Board of Commissioners to accommodate
   the public to the greatest extent possible.  Therefore, this
   agenda has been prepared with items of greatest public
   interest at the beginning with more routine items toward the
   end as a courtesy to those who wish to speak with the County

6) CONSENT ITEMS:  These are items of business before the
   Lancaster County Board of Commissioners which have been
   previously supplied to each Commissioner in writing, which
   are relatively routine and which are expected to be adopted
   without dissent.  Any individual item may be removed for
   special discussion and consideration by a Commissioner or by
   any member of the public without prior notice.  Unless there
   is an exception, these items will be approved as one with a
   single vote of the Board of Commissioners.  These items are

7) ANNOUNCEMENTS:

   A.  The Lancaster County Board of Commissioners will not hold
       a meeting on Thursday, November 6, 1997, instead it will
       be held on Tuesday, November 4th at 8:30 a.m. in the
       Commissioners Hearing Room on first floor of the
       County-City Building.

   B.  A public hearing will be held on Wednesday, November 5,
       1997 at 7:30 p.m. in the Commissioners Hearing Room on
       the first floor of the County-City Building regarding
       Lancaster County's proposed "One-and Six-Year Road and
       Bridge Improvement Program for the fiscal years beginning
       July 1, 1997 through June 30, 2003".

   C.  A public hearing will be held on Thursday, November 13,
       1997 at 1:30 p.m. in the Commissioners Hearing Room on
       the first floor of the County-City Building on County
       Board of Zoning Appeals, Appeal 105, requested by Tom
       Wilson on behalf of Marty Ivins, alleging an error in the
       interpretation of the Lancaster County Zoning Resolution,
       Sections 2.067 and 15.001, regarding definitions and
       conditions where a home occupation may occur.  (97-189)

   D.  The Lancaster County Board of Commissioners meeting which
       is broadcast live at 1:30 p.m. on Tuesdays will be re-broadcast
       at 6:30 p.m. on Cablevision Channel 5.

Commissioners Present: Linda Steinman, Chair Kathy Campbell Larry Hudkins Steve Svoboda Darlene Tussing Others Present: Kandra Hahn, County Clerk Kerry Eagan, Chief Administrative Officer Diane Staab, Deputy County Attorney 1) MINUTES: Approval of the minutes of the Board of Commissioners meeting held on Tuesday, October 28, 1997. (Copies of these minutes are on file in the Office of the Lancaster County Clerk.) Steinman requested a correction to Item 6H on page five of the minutes to reflect that the County will observe Veterans Day on November 11, 1997 instead of November 13th. MOTION: Hudkins moved and Campbell seconded approval of the minutes of October 28, 1997 with the correction to Item 6H. On call Campbell, Hudkins, Steinman and Svoboda voted aye. Tussing abstained. Motion carried. 2) CLAIMS: Approval of all claims processed through Tuesday, November 4, 1997. MOTION: Tussing moved and Campbell seconded approval. The Volunteer of the Month Award was presented to Larry Pershing for his services with Lancaster County Cooperative Extension. B. Introduction of Karen Chinn, Michael J. McMillen, Sparty B. Hammett and Earl Dunlap - Dennis Banks, Director of the Attention Center Dennis Banks, Director of the Attention Center, appeared and introduced Karen Chinn with Chinn Planning, Inc. who will conduct a comprehensive study of the juvenile justice system. Chinn explained they will be collecting data and information regarding what the County currently has in their system, services available to youth, trends in the court and detention center and community based programs. An assessment will be presented in December with recommendations to made in January. C. Dennis Banks, Director of the Attention Center, recognized Sharon Baker, as Heartland Juvenile Detention Worker of the Year and Hamilton Green, as Heartland Juvenile Detention Association Line Staff Worker of the Year. D. Demonstration of the OASIS System on the Internet was presented by Norm Agena, County Assessor; Robin Hendricksen, Chief Deputy Assessor; Terry Lowe and Chris Plock, Information Services Hendricksen gave a brief overview of OASIS System information available and how it may be accessed. He stated a search may also be done by accessing the County Treasurer's home page which would include information regarding the tax rate, original tax, tax status (whether taxes have been paid) and a breakdown of the taxes. Gary Lacey, County Attorney, asked when the court records could be put on the Internet. Doug Thomas, Information Services, appeared and said they will be working on Special Assessments and then they would work with Marjorie Hart, District Court Clerk and Bruce Medcalf, Deputy District Court Clerk, on placing information regarding child support on the Internet. Dick Nuernberger, County Treasurer, appeared and gave a brief overview of options available on the system regarding real estate taxes. He said in the future they hope the public can make their real estate tax payments electronically. Lacey asked if the County Clerk's new indexing system would be accessed by the InterLinc. Kandra Hahn, County Clerk, said that is the intent. 4) OLD BUSINESS: A. (Change of Zone 139) (97-256) (R-5589) Campbell explained Mike Rierden, attorney representing LeRoy Busboom, had to leave due to time constraints, however, he requested the zoning change be withdrawn in its entirety. No further action taken. 5) NEW BUSINESS: A. Authorization of the use of County Engineer equipment and personnel for storm clean-up in the City of Lincoln. (97-238) Don Thomas, County Engineer, appeared and explained it was their intention to help with personnel and equipment. He said they can guarantee three to four trucks for the remainder of the week with intermittent use in the following weeks. Thomas said it was his intent to avoid overtime inside the city limits due to the budget impact and a question regarding the ability for reimbursement. Thomas said he had driven through all cities and villages, with the exception of Bennet, and reported some have a fair amount of damage. Davey, Raymond and Denton are burning their debris. He said damage to the County road system is minimal. MOTION: Tussing moved and Campbell seconded approval. On call Tussing, Campbell, Hudkins, Steinman and Svoboda voted aye. Motion carried. B. (97-271) Diane Staab, Deputy County Attorney, explained Mr. Stokey is a probationary employee and is not covered by the American Federation of State, Municipal and County Employees (ASFMCE) contract. She added Stokey was not injured and would not be covered by Workers Compensation. Larry Worrell, County Surveyor, recommended reimbursement of the eyeglasses. MOTION: Tussing moved and Hudkins seconded approval of the claim filed by Joe Stokey, in the amount of $274.93, with the money to come from the County Engineer's budget. On call Hudkins, Steinman, Svoboda, Tussing and Campbell voted aye. Motion carried. D. An agreement with the State of Nebraska, Department of Roads for funding through Federal-Aid Bridge Improvement Funds, for a project at Stevens Creek (Project BRO-7055(99). (97-247) (M-6547) Terry Wagner, Sheriff, explained the Merit Commission is created by statute and that there are three members. One is a serving deputy sheriff elected by the remaining deputy sheriffs, one is an elected county official appointed by the county board and one is a member at large appointed by the district judges. He explained Nolte has been serving on the commission for a number of years and had agreed to continue to serve. MOTION: Hudkins moved and Svoboda seconded approval. On call Svoboda, Tussing, Campbell, Hudkins and Steinman voted aye. On call Svoboda, Tussing, Campbell, Hudkins and Steinman voted aye. Motion carried. The Chair recessed the Board of Equalization meeting and reconvened it at 2:30 p.m. 5) NOTICE OF VALUATION CHANGE FOR OMITTED OR UNDERVALUED PROPERTY: First Equity Corporation I L Partners (2 notices) Rieke Metals Inc. The Assessor recommended a new value of $24,327 for First Equity Corporation; a new value of $110,394 for Parcel I.D. No. 11-10-102-011-000 and $39,382 for Parcel I.D. No. 11-10-105-001-000 for I L Partners and a new value of $62,224 for Rieke Metals Inc. MOTION: Hudkins moved and Tussing seconded to accept the Assessor's recommendation and set a value of $24,327 for First Equity Corporation; $110,394 for Parcel I.D.
