1) MINUTES: Approval of the minutes of the Board of Commissioners meeting held on Tuesday, July 22, 1997. (A copy of these minutes is on file in the Office of the Lancaster County Clerk.) 2) CLAIMS: Approval of all claims processed through Tuesday, July 29, 1997, with the exception that the vote of any Commissioner who might have a conflict of interest in the payment of any claim shall be deemed an abstention from approval for such claims alone. 3) ITEMS OF PUBLIC PARTICIPATION: It is the policy of the Lancaster County Board of Commissioners to accommodate the public to the greatest extent possible. Therefore, this agenda has been prepared with items of greatest public interest at the beginning with more routine items toward the end as a courtesy to those who wish to speak with the County Board at this meeting. Campbell requested Item 4B under New Business of the minutes of July 22, 1997 be corrected to delete reference of the ownership of the building. MOTION: Campbell moved and Tussing seconded approval of the minutes of July 22, 1997 with a correction which would delete reference of ownership of the building on Item 4B under New Business. On call Campbell, Hudkins, Steinman and Tussing voted aye. Svoboda abstained. The Volunteer of the Month Award was presented to Mary Ann Hamilton for her services with Lincoln Police Department. 5) NEW BUSINESS: F. Informational signage regarding the YMCA Wright Field at the following locations: Westbound traffic on Pioneers Blvd between Folsom Street and Highway 77 Northbound traffic on Folsom Street south of Pioneers Blvd Jolleen Clymer, Chief Executive Officer of the Young Men's Christian Association, appeared and explained the idea for the signage came about as a result of a meeting with the Yankee Hill Neighborhood Association. She said they are looking for support to install the signage so they can minimize the traffic congestion outside the park. Steinman stated Pioneers Boulevard is a State road. Don Thomas, County Engineer, said he thought half of the road was the State's and the other half was County, however, he would review it. MOTION: Campbell moved and Hudkins seconded to approve Resolution 5533 subject to approval by the State of Nebraska, Department of Roads. On call Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye. Motion carried. 4) PUBLIC HEARINGS: A. Lyle Loth, ESP Engineer, appeared on behalf of Pearle Finigan and explained this would be the completion of a preliminary plat which began 1978. No one appeared in opposition. Mike DeKalb, Planning, appeared in a neutral position. He said the preliminary plat was ready and the final plat had been submitted. The Chair closed the public hearing. MOTION: Tussing moved and Campbell seconded approval of Resolution 5530. On call Tussing, Campbell, Hudkins, Steinman and Svoboda voted aye. Motion carried. C. A special permit, Branched Oak Lakeside Acres, requested by Jack Tuma for WTK Company, Inc., consisting of 15 dwelling units within 1,320 feet of public lake property, located west of Branched Oak Lake on Northwest 140th Street and West Rock Creek Road in Lancaster County, Nebraska (Special Permit 148). The Chair opened the public hearing. Hudkins explained his farming operation was approximately one-half mile from the proposed location of Branched Oak Lakeside Estates. He said he has asked that a letter be sent to the Nebraska Accountability and Disclosure Commission requesting a response as to whether there would be a conflict of interest on voting on Branched Oak Acres. The alleged basis of the conflict would be that any action taken by Lancaster County in approving the subdivision of land in the area could have an affect of increasing the value of his property. Hudkins stated he had no intentions of developing his property. A copy of the letter to the Accountability and Disclosure Commission, along with several maps, was submitted into the record (Exhibit A). Michael Rierden, attorney representing the applicants, appeared and submitted new drawings. He explained that the original proposal was for 15 lots with the issues being the 200 yard buffer zone and density. He said, after review, they have now reduced the density to 11 lots. The differences between the original request (15 lots) and the current request (11 lots) are as follows: a. Elimination of road to the south which connected with the Guenzel property b. Relocation of road connecting to the northeast corner of the Guenzel property c. Extend the 200 yards from the property line on Lots 4 and 5 d. Request of a waiver of 25 yards on Lot 6 in order to allow for a buildable lot and a road connection Submitted into the record by Rierden were the following: a. Letter from Steven Guenzel (Exhibit B) b. Proposed language for notification to future owners of lots regarding the activities of the Nebraska Field Trial Association who lease land from the Nebraska Game and Parks Commission, generated vehicle trips and the change in Seward County's zoning ordinance (Exhibit C) c. A motion for deletion of Condition 1.2.13 and substitution of new language (Exhibit D) Jerry Lawton, who farms property owned by his cousin which abuts the property, said he was in favor of the development. He explained that the road on the south end of their property had been closed by the County. Lawton said they do have an easement, however, it isn't maintained very well and is difficult to get equipment through to their farm ground. The Chair asked if anyone wished to testify in opposition. Mark Brohman of the Nebraska Game and Parks Commission testified in opposition. He stated they still feel Branched Oak Lake needs the most protection and that their biggest concern is the 200 yard buffer zone. Brohman told the Board it would be almost impossible to enforce the buffer zone statute if the 25 yard waiver were granted for Lot 6. Other concerns of Brohman's were as follows: a. Increased traffic and the noise of heavy farm equipment b. Change in landscape c. Notice provision in the covenants d. Sewage e. Water Edsel Grove, Nebraska Field Trial Association, appeared in opposition and submitted a petition of signatures in opposition (Exhibit E). He said they support the 200 yard buffer and some type of protective covenant preventing nuisance lawsuits. Charles Truelson, attorney for the Nebraska Field Trial Association, appeared and discussed the notification provision to purchasers. He suggested Number 12 in the preliminary plat should be modified to read "notification to and restrictions of purchasers". There should also be additional language in Number 12 stating "and purchasers are restricted from and are hereby deemed to waive, now and in the future, any complaints regarding said uses". Tom Lanz, Safari Club International, Nebraska Chapter, appeared and said he was pleased to see the lower density, however, he urged the Board to seriously look at Lawton's property. He expressed concern about setting a precedent for developments. Steve Mann, 1411 D Street, appeared and expressed his opposition. Campbell asked if she was correct in her understanding that the County must have road connections. Mike DeKalb, Planning Department, appeared in a neutral position and explained the County's design standards require connections at the quarter-mile so that abutting lands can be developed, however, a waiver may be obtained. At the direction of the Chair, the public hearings for a preliminary plat and a special permit for Branched Oak Lakeside Acres will be continued to Tuesday, August 12, 1997 at 1:30 p.m. 5) NEW BUSINESS: A. An application for a Special Designated Permit from the Nebraska State Board of Agriculture to hold the Anheuser- Busch "Budweiser Beer School" on the State Fair grounds from Friday, August 22, 1997 through Monday, September 1, 1997, hours will be from 9 a.m. to midnight each day, except Sundays when the hours will be noon to midnight. MOTION: Tussing moved and Svoboda seconded approval. Sharon Schrock, Nebraska State Board of Agriculture and Gil Goldsmith, D & D Distributing, appeared. Campbell asked if the "Budweiser Beer School" was the only alcohol served at State Fair Park during the State Fair. Schrock replied that they have beer gardens which are permanently licensed. Campbell also asked how many times an individual can go through the school. Goldsmith said the cups are seven ounces and explained that the chances of someone being intoxicated in the class are very slim. He added they don't plan on serving anyone who is intoxicated. ROLL CALL: Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye. Motion carried. B. Sue Eckley, Safety and Training Officer, gave a brief explanation regarding the claim and indicated the property belongs to the Public Building Commission. She said there is a question as to whether the County should pay the claim or the Public Building Commission. Diane Staab, Deputy County Attorney, recommended the County pay the claim with reimbursement by the Public Building Commission. MOTION: Campbell moved and Hudkins seconded approval of the claim in the amount of $199.36. On call Campbell, Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried. E.
