1997 Regular Agendas & Minutes



Agenda for the regular Board of Commissioners meeting to be held in the County Commissioners Hearing Room, First Floor, County-City Building.
Tuesday, July 29, 1997 at 1:30 p.m.

 1)  MINUTES:  Approval of the minutes of the Board of Commissioners
               meeting held on Tuesday, July 22, 1997.
               (A copy of these minutes is on file in the Office of
               the Lancaster County Clerk.)

 2)  CLAIMS:   Approval of all claims processed through Tuesday,
               July 29, 1997, with the exception that the vote of any
               Commissioner who might have a conflict of interest in
               the payment of any claim shall be deemed an abstention
               from approval for such claims alone.

 3)  ITEMS OF PUBLIC PARTICIPATION:  It is the policy of the
     Lancaster County Board of Commissioners to accommodate the public to
     the greatest extent possible.  Therefore, this agenda has been
     prepared with items of greatest public interest at the beginning
     with more routine items toward the end as a courtesy to those who
     wish to speak with the County Board at this meeting.  If you are
     here to participate on an item and need special consideration
     because of a schedule conflict or some other problem, would you
     please let us know now so we can try to meet your needs.

  *  Presentation of the Volunteer of the Month Award to Mary Ann
     Hamilton for her services with Lincoln Police Department.

     COMMENTS FROM PUBLIC ON AGENDA ITEMS:  Members of the
     public who wish to comment on any item on the agenda may come
     forward at this time.

 4)  PUBLIC HEARINGS:

     A.  Adoption of the Public Access Policy and Fee Schedule for
         City-County Geographic Information System (GIS) data files
         (Resolution No. 5529).

     B.  A preliminary plat for Finigan's 1st Addition, requested by
         Pearle Finigan, consisting of eight single family lots, on
         property located at the northeast corner of 84th Street and
         Waverly Road in Lancaster County, Nebraska (Preliminary Plat
         97006) (Resolution No. 5530).

     C.  A preliminary plat for Branched Oak Lakeside Acres, requested
         by Jack Tuma for WTK Company, Inc., consisting of 15 single
         family lots, on property located west of Branched Oak Lake on
         Northwest 140th Street and West Rock Creek Road in Lancaster
         County, Nebraska (Preliminary Plat 97008).

     D.  A special permit, Branched Oak Lakeside Acres, requested by
         Jack Tuma for WTK Company, Inc., consisting of 15 dwelling
         units within 1,320 feet of public lake property, located west
         of Branched Oak Lake on Northwest 140th Street and West Rock
         Creek Road in Lancaster County, Nebraska (Special Permit
         148).

 5)  NEW BUSINESS:

     A.  An application for a Special Designated Permit from the
         Nebraska State Board of Agriculture to hold the Anheuser-
         Busch "Budweiser Beer School" on the State Fair grounds from
         Friday, August 22, 1997 through Monday, September 1, 1997,
         hours will be from 9 a.m. to midnight each day, except
         Sundays when the hours will be noon to midnight.

     B.  An application for a Special Designated License from Wine
         Merchants Inc. to hold the Lincoln High School Class of '62
         Reunion on Friday, August 8, 1997 from 5 p.m. to 1 a.m. at
         Boss Hog's Party Barn located at 6305 West Adams.

     C.  Appointments to the Lincoln-Lancaster County Planning
         Commission:

         of Law for the Lancaster County Public Defender to establish
         a Clinical Program involving the mental health caseload of
         the Public Defender beginning August 4, 1997 and ending
         September 4, 1997.

     I.  Contract amendment #5 with Region V for the Lancaster County
         Community Mental Health Center, extending the present level
         of funding through September 1997.

     J.  An agreement with Region V establishing the Lancaster County
         Community Mental Health Center as a provider of for emergency
         protective care services to other counties in Region V at the
         rate of $78 per individual beginning July 1, 1997 to
         September 30, 1997.


 6)  CONSENT ITEMS:  These are items of business before the Lancaster
     County Board of Commissioners which have been previously supplied
     to each Commissioner in writing, which are relatively routine and
     which are expected to be adopted without dissent.  Any individual
     item may be removed for special discussion and consideration by a
     Commissioner or by any member of the public without prior notice.
     Unless there is an exception, these items will be approved as one
     with a single vote of the Board of Commissioners.  These items
     are consideration of:

     A.  Monthly report for June 1997 for the County Sheriff.

     B.  Renewal of a service agreement with Microfilm Imaging Systems
         for Records and Information Management, in the amount of
         $920.

     C.  A user's agreement with WHY USA Harrington Realty for remote
         access to Lancaster County records, at a rate of $.013 per
         transaction.

     D.  A contract with Harold F. and Aldyth E. Paschold for the
         Lancaster County Engineer for the purchase of road materials
         to be used on Firth Road between U.S. Highway No. 77 and
         South 68th Street, in the amount of $10.

     E.  Contracts relating to road improvements with the following:

 7)  ANNOUNCEMENTS:

     A.  The Lancaster County Board of Commissioners will hold a
         meeting on Thursday, July 31, 1997 at 8:30 a.m. in the Fourth
         Floor Conference Room in the County-City Building.

     B.  Public hearings are scheduled for Tuesday, August 5, 1997 at
         1:30 p.m. in the Commissioners Hearing Room located on the
         first floor of the County-City Building for the following:

         A change of zone, from AG Agricultural to R Residential,
         requested by Nelvadine Lienemann, on property located at the
         northwest corner of Highway 77 (South 12th Street) and "B"
         Street in Princeton in Lancaster County, Nebraska (Change of
         Zone Number 173).

         A change of zone, text amendment to Article 17.021 of the
         County Zoning Resolution, requested by the County Engineer,
         to allow highway contractors who have contracts to pave
         federal, state and county roads, to located temporary paving
         plant operations associated with the contract in all zoning
         districts as a conditional use (Change of Zone Number 174).

         A change of zone, from AG Agricultural to AGR Agricultural
         Residential, requested by Mark Paschke, on property located
         north and east of the corner of Southwest 2nd and Bennet Road
         in Lancaster County, Nebraska (Change of Zone Number 175).

     C.  A public hearing will be held on Tuesday, August 12, 1997 at
         1:30 p.m. in the Commissioners Hearing Room located on the
         first floor of the County-City Building regarding the
         County's General Assistance Plan Burial Section.

     D.  A public hearing will be held on Tuesday, August 12, 1997 at
         7 p.m. in the Commissioners Hearing located on the first
         floor of the County-City Building regarding Lancaster
         County's Budget for Fiscal Year 1997-1998 with adoption
         scheduled for Tuesday, August 26, 1997.

     E.  The Lancaster County Board of Commissioners meeting which is
         broadcast live at 1:30 p.m. on Tuesdays will be re-broadcast
         at 6:30 p.m. on Cablevision Channel 5.

     A.  Change of Zone Number 147, from AG Agricultural to AGR
         Agricultural Residential, requested by Peter W. Katt on
         behalf of Steve Champoux, on property located at the
         northwest corner of 134th and "A" Streets in Lancaster
         County, Nebraska.

     B.  Change of Zone Number 139, from AG Agriculture to AGR
         Agricultural Residential, requested by LeRoy F. Busboom, on
         property located at the northeast corner of Southwest 112th
         Street and West Pioneers Boulevard in Lancaster County,
         Nebraska.  (This item is scheduled for further discussion on
         Tuesday, August 19, 1997 at 1:30 p.m.)

     C.  County Change of Zone Number 165, from AG Agricultural to
         AGR Agricultural Residential, requested by Harry Muhlbach, on
         property located west of North 56th Street (Highway 77)

 1) MINUTES:   Approval of the minutes of the Board of Commissioners
               meeting held on Tuesday, July 22, 1997.

               Campbell requested Item 4B under New Business of the
               minutes of July 22, 1997 be corrected to delete
               reference of the ownership of the building.

     MOTION:   Campbell moved and Tussing seconded approval of the
               minutes of July 22, 1997 with a correction which would
               delete reference of ownership of the building on Item
               4B under New Business.  On call Campbell, Hudkins,
               Steinman and Tussing voted aye.  Svoboda abstained.
               Motion carried.

 3)  The Clerk said there had been a request to hear Item 5F under New
     Business earlier in the agenda.

     The Chair recommended hearing the item prior to public hearings.

     The Volunteer of the Month Award was presented to Mary Ann
     Hamilton for her services with Lincoln Police Department.

 5) NEW BUSINESS:

     F.  Informational signage regarding the YMCA Wright Field at the
         following locations:

         Westbound traffic on Pioneers Blvd between Folsom Street and
         Highway 77

         Northbound traffic on Folsom Street south of Pioneers Blvd

         Jolleen Clymer, Chief Executive Officer of the Young Men's
         Christian Association, appeared and explained the idea for
         the signage came about as a result of a meeting with the
         Yankee Hill Neighborhood Association.

         She said they are looking for support to install the signage
         so they can minimize the traffic congestion outside the park.

         Steinman stated Pioneers Boulevard is a State road.

         Don Thomas, County Engineer, said he thought half of the road
         was the State's and the other half was County, however, he
         would review it.

         MOTION:  Campbell moved and Hudkins seconded to approve
                  Resolution 5533 subject to approval by the State of
                  Nebraska, Department of Roads.  On call Steinman,
                  Svoboda, Tussing, Campbell and Hudkins voted aye.
                  Motion carried.

         wished to testify in favor, opposition or in a neutral
         position.

         No one appeared and the Chair closed the public hearing.

                  Resolution 5529.  On call Svoboda, Tussing,
                  Campbell, Hudkins and Steinman voted aye.  Motion
                  carried.

     B.  A preliminary plat for Finigan's 1st Addition, requested by
         Pearle Finigan, consisting of eight single family lots, on
         property located at the northeast corner of 84th Street and

         Steinman opened the public hearing and asked if anyone wished
         to testify in favor of the preliminary plat.

         Lyle Loth, ESP Engineer, appeared on behalf of Pearle Finigan
         and explained this would be the completion of a preliminary
         plat which began 1978.

         No one appeared in opposition.

         Mike DeKalb, Planning, appeared in a neutral position.  He
         said the preliminary plat was ready and the final plat had
         been submitted.

         The Chair closed the public hearing.

         MOTION:  Tussing moved and Campbell seconded approval of
                  Resolution 5530.  On call Tussing, Campbell,
                  Hudkins, Steinman and Svoboda voted aye.  Motion
                  carried.

     C.  A preliminary plat for Branched Oak Lakeside Acres, requested
         by Jack Tuma for WTK Company, Inc., consisting of 15 single
         family lots, on property located west of Branched Oak Lake on
         Northwest 140th Street and West Rock Creek Road in Lancaster
         County, Nebraska (Preliminary Plat 97008).

     D.  A special permit, Branched Oak Lakeside Acres, requested by
         Jack Tuma for WTK Company, Inc., consisting of 15 dwelling
         units within 1,320 feet of public lake property, located west
         of Branched Oak Lake on Northwest 140th Street and West Rock
         Creek Road in Lancaster County, Nebraska (Special Permit
         148).

         The Chair opened the public hearing.

         Hudkins explained his farming operation was approximately
         one-half mile from the proposed location of Branched Oak
         Lakeside Estates.  He said he has asked that a letter be sent
         to the Nebraska Accountability and Disclosure Commission
         requesting a response as to whether there would be a
         conflict of interest on voting on Branched Oak Acres.  The
         alleged basis of the conflict would be that any action taken
         by Lancaster County in approving the subdivision of land in
         the area could have an affect of increasing the value of his
         property.  Hudkins stated he had no intentions of developing
         his property.  A copy of the letter to the Accountability and
         Disclosure Commission, along with several maps, was submitted
         into the record (Exhibit A).

         Michael Rierden, attorney representing the applicants,
         appeared and submitted new drawings.  He explained that the
         original proposal was for 15 lots with the issues being the
         200 yard buffer zone and density.  He said, after review,
         they have now reduced the density to 11 lots.  The
         differences between the original request (15 lots) and the
         current request (11 lots) are as follows:

         a.  Elimination of road to the south which connected with the
             Guenzel property
         b.  Relocation of road connecting to the northeast corner of
             the Guenzel property
         c.  Extend the 200 yards from the property line on Lots 4
             and 5
         d.  Request of a waiver of 25 yards on Lot 6 in order to
             allow for a buildable lot and a road connection

         Submitted into the record by Rierden were the following:

         a.  Letter from Steven Guenzel (Exhibit B)
         b.  Proposed language for notification to future owners of
             lots regarding the activities of the Nebraska Field Trial
             Association who lease land from the Nebraska Game and
             Parks Commission, generated vehicle trips and the change
             in Seward County's zoning ordinance (Exhibit C)
         c.  A motion for deletion of Condition 1.2.13 and
             substitution of new language (Exhibit D)

         Jerry Lawton, who farms property owned by his cousin which
         abuts the property, said he was in favor of the development.
         He explained that the road on the south end of their property
         had been closed by the County.  Lawton said they do have an
         easement, however, it isn't maintained very well and is
         difficult to get equipment through to their farm ground.

         The Chair asked if anyone wished to testify in opposition.

         Mark Brohman of the Nebraska Game and Parks Commission
         testified in opposition.  He stated they still feel Branched
         Oak Lake needs the most protection and that their biggest
         concern is the 200 yard buffer zone.  Brohman told the Board
         it would be almost impossible to enforce the buffer zone
         statute if the 25 yard waiver were granted for Lot 6.

         Other concerns of Brohman's were as follows:

         a.  Increased traffic and the noise of heavy farm equipment
         b.  Change in landscape
         c.  Notice provision in the covenants
         d.  Sewage
         e.  Water

         Edsel Grove, Nebraska Field Trial Association, appeared in
         opposition and submitted a petition of signatures in
         opposition (Exhibit E).  He said they support the 200 yard
         buffer and some type of protective covenant preventing
         nuisance lawsuits.

         Charles Truelson, attorney for the Nebraska Field Trial
         Association, appeared and discussed the notification
         provision to purchasers.  He suggested Number 12 in the
         preliminary plat should be modified to read "notification to
         and restrictions of purchasers".  There should also be
         additional language in Number 12 stating "and purchasers are
         restricted from and are hereby deemed to waive, now and in
         the future, any complaints regarding said uses".

         Tom Lanz, Safari Club International, Nebraska Chapter,
         appeared and said he was pleased to see the lower density,
         however, he urged the Board to seriously look at Lawton's
         property.  He expressed concern about setting a precedent for
         developments.

         Steve Mann, 1411 D Street, appeared and expressed his
         opposition.

         Campbell asked if she was correct in her understanding that
         the County must have road connections.

         Mike DeKalb, Planning Department, appeared in a neutral
         position and explained the County's design standards require
         connections at the quarter-mile so that abutting lands can be
         developed, however, a waiver may be obtained.

         At the direction of the Chair, the public hearings for a
         preliminary plat and a special permit for Branched Oak
         Lakeside Acres will be continued to Tuesday, August 12, 1997
         at 1:30 p.m.


 5) NEW BUSINESS:

     A.  An application for a Special Designated Permit from the
         Nebraska State Board of Agriculture to hold the Anheuser-
         Busch "Budweiser Beer School" on the State Fair grounds from

         hours will be from 9 a.m. to midnight each day, except

         MOTION:  Tussing moved and Svoboda seconded approval.

         Sharon Schrock, Nebraska State Board of Agriculture and Gil
         Goldsmith, D & D Distributing, appeared.

         Campbell asked if the "Budweiser Beer School" was the only
         alcohol served at State Fair Park during the State Fair.

         Schrock replied that they have beer gardens which are
         permanently licensed.

         Campbell also asked how many times an individual can go
         through the school.

         Goldsmith said the cups are seven ounces and explained that
         the chances of someone being intoxicated in the class are
         very slim.  He added they don't plan on serving anyone who is
         intoxicated.

         ROLL CALL:  Steinman, Svoboda, Tussing, Campbell and Hudkins
                     voted aye.  Motion carried.

     B.  An application for a Special Designated License from Wine
         Merchants Inc. to hold the Lincoln High School Class of '62
         Reunion on Friday, August 8, 1997 from 5 p.m. to 1 a.m. at
         Boss Hog's Party Barn located at 6305 West Adams.

         MOTION:  Campbell moved and Tussing seconded approval with
                  the condition that no parking be allowed on the
                  public roadways.  On call Svoboda, Tussing,
                  Campbell, Hudkins and Steinman voted aye.  Motion
                  carried.

     C.  Appointments to the Lincoln-Lancaster County Planning
         Commission:

     D.  A political subdivision tort claim filed by Julie Benesch
         against Lancaster County for damages to her vehicle.

         Sue Eckley, Safety and Training Officer, gave a brief
         explanation regarding the claim and indicated the property
         belongs to the Public Building Commission.  She said there is
         a question as to whether the County should pay the claim or
         the Public Building Commission.

         Diane Staab, Deputy County Attorney, recommended the County
         pay the claim with reimbursement by the Public Building
         Commission.

         MOTION:  Campbell moved and Hudkins seconded approval of the
                  claim in the amount of $199.36.  On call Campbell,
                  Hudkins, Steinman, Svoboda and Tussing voted aye.
                  Motion carried.

 6) CONSENT ITEMS:  These are items of business before the Lancaster
     County Board of Commissioners which have been previously supplied
     to each Commissioner in writing, which are relatively routine and
     which are expected to be adopted without dissent.  Any individual
     item may be removed for special discussion and consideration by a
     Commissioner or by any member of the public without prior notice.
     Unless there is an exception, these items will be approved as one
     with a single vote of the Board of Commissioners.  These items
     are consideration of:

     A.  Monthly report for June 1997 for the County Sheriff.

     B.  Renewal of a service agreement with Microfilm Imaging Systems
         for Records and Information Management, in the amount of
         $920.

     C.  A user's agreement with WHY USA Harrington Realty for remote
         access to Lancaster County records, at a rate of $.013 per
         transaction.

     D.  A contract with Harold F. and Aldyth E. Paschold for the
         Lancaster County Engineer for the purchase of road materials
         to be used on Firth Road between U.S. Highway No. 77 and
         South 68th Street, in the amount of $10.

(A copy of these minutes is on file in the Office of the Lancaster County Clerk.) MOTION: Hudkins moved and Tussing seconded approval. On call Campbell, Hudkins, Steinman and Tussing voted aye. Svoboda abstained. Motion carried. 2) ADDITIONS AND DEDUCTIONS: Approval of 12 additions and deductions to the tax assessment rolls per Exhibit "A". MOTION: Hudkins moved and Tussing seconded to accept the Assessor's recommendation and set the value at $132,400 for David W and Jennifer L Fosler. On call Campbell, Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried. The Assessor recommended setting the value for Dean B and Christine Rasmussen at $107,600. MOTION: Tussing moved and Campbell seconded to accept the Assessor's recommendation and set the value at $107,600 for Dean B and Christine Rasmussen.
