Agenda for the regular Board of Commissioners meeting to be held in the County Commissioners Hearing Room, First Floor, County-City Building.
Tuesday, July 8, 1997 at 1:30 p.m.

 1) MINUTES:  Approval of the minutes of the Board of Commissioners
               meeting held on Tuesday, July 1, 1997.
               (A copy of these minutes is on file in the Office of
               the Lancaster County Clerk.)

 2) CLAIMS:   Approval of all claims processed through Tuesday, July
               8, 1997, with the exception that the vote of any
               Commissioner who might have a conflict of interest in
               the payment of any claim shall be deemed an abstention
               from approval for such claims alone.

 3) ITEMS OF PUBLIC PARTICIPATION:  It is the policy of the Lancaster
     County Board of Commissioners to accommodate the public to the
     greatest extent possible.  Therefore, this agenda has been
     prepared with items of greatest public interest at the beginning
     with more routine items toward the end as a courtesy to those who
     wish to speak with the County Board at this meeting.  If you are
     here to participate on an item and need special consideration
     because of a schedule conflict or some other problem, would you
     please let us know now so we can try to meet your needs.

     COMMENTS FROM PUBLIC ON AGENDA ITEMS:  Members of the public

     who wish to comment on any item on the agenda may come
     forward at this time.

 4) NEW BUSINESS:

     A.  An application for a Special Designated License from BJK Inc.
         to hold a wedding reception at Boss Hog's Party Barn,
         located at 6305 West Adams, on Saturday, July 19, 1997 from 6
         p.m. to 12 a.m.

     B.  Approval of two final payment vouchers through Lincoln
         Action Program's Rural Housing Rehabilitation Program for the
         following individuals:

     C.  Approval of a grant award from the Nebraska Commission on Law
         Enforcement and Criminal Justice, for $3,615.60, for a
         Comprehensive System of Care (Tracker Program) for Juvenile
         Court.

     D.  Addendum to an agreement with Ugai & Lindgren for legal
         services extending the term to two years, from July 1, 1997
         through June 30, 1999.

     E.  An agreement with Educational Management, Inc. dba/Lincoln
         School of Commerce for a Federal Work Study Program with the
         Corrections Department to provide eligible students with
         work, at a rate of $5.80 per hour.

     F.  An agreement with Docuphase, Inc. to provide additional
         computer and consultation training for the County Clerk's
         Office for the County Records System, in an amount not to
         exceed $3,000, commencing upon execution of the agreement.

 5) CONSENT ITEMS:  These are items of business before the Lancaster
     County Board of Commissioners which have been previously supplied
     to each Commissioner in writing, which are relatively routine and
     which are expected to be adopted without dissent.  Any individual
     item may be removed for special discussion and consideration by a
     Commissioner or by any member of the public without prior notice.
     Unless there is an exception, these items will be approved as one
     with a single vote of the Board of Commissioners.  These items
     are consideration of:

     A.  Monthly reports for the following:

         County Engineer
         County Geographic Information System (GIS)
         Sheriff's Office


     B.  Setting of the following public hearings for
         Tuesdy, July 29, 1997 at 1:30 p.m. in the
         Commissioners Hearing Room on the first floor
         of the County-City Building:

         A preliminary plat for Finigan's 1st Addition,
         requested by Pearle Finigan, consisting of eight
         single family lots, on property located at the
         northeast corner of 84th Street and Waverly Road in
         Lancaster County, Nebraska (Preliminary Plat 97006).

         A preliminary plat for Branched Oak Lakeside Acres,
         requested by Jack Tuma for WTK Company, Inc.,
         consisting of 15 single family lots, on property
         located west of Branched Oak Lake on Northwest 140th
         Street and West Rock Creek Road in Lancaster County,
         Nebraska (Preliminary Plat 97008).

         A special permit, Branched Oak Lakeside Acres,
         requested by Jack Tuma for WTK Company, Inc.,
         consisting of 15 dwelling units with 1,320 feet of
         public lake property, located west of Branched Oak

     A.  The Lancaster County Board of Commissioners will a meeting on
         Thursday, July 10, 1997 at 8:30 a.m. in the Fourth Floor
         Conference Room of the County-City Building.

     B.  The Lancaster County Board of Commissioners have scheduled
         budget meetings to be held in the Fourth Floor Conference
         Room of the County-City Building as follows:

         Thursday, July 10, 1997 at 8:30 a.m. - Working Session*
         Thursday, July 17, 1997 at 8:30 a.m. - Working Session

         *Common Budget Meeting for joint budgets - Tentative date
         of July 10, 1997; location and time to be announced.

         Tuesday, July 15, 1997 from 8 a.m. to 10 a.m.; Board Proposed
         Budget Working Session; County-City Building, Register of
         Deeds Conference Room.

         A public hearing will be held on Tuesday, August 12, 1997 at
         7 p.m. in the Commissioners Hearing Room on the first floor
         of the County-City Building.

         Adoption of the County Budget will be on Tuesday, August 26,
         1997.

     C.  Hearings with referees regarding 1997 Real Estate Valuation
         Protests are now being held and will continued through July
         15 at Trabert Hall, 2202 South 11th Street.  The Board of
         Equalization has set final hearings for:

         1 - 4:30 p.m. Thursday, July 17
         9 a.m. - Noon and 1 - 4:30 p.m. Friday, July 18
         9 a.m. - Noon Tuesday, July 22
         9 a.m. - Noon and 1 - 4:30 p.m. Wednesday, July 23
         1 - 4:30 p.m. Thursday, July 24
         If needed, July 25

     D.  The Lancaster County Board of Commissioners meeting which is
         broadcast live at 1:30 p.m. on Tuesdays will be re-broadcast
         at 6:30 p.m. on Cablevision Channel 5.

         Agricultural Residential, requested by Peter W. Katt on

     B.  County Change of Zone Number 139, from AG Agriculture to AGR
         Agricultural Residential, requested by LeRoy F. Busboom, on

     MOTION:    Svoboda moved and Hudkins seconded approval.  On call
                Hudkins, Steinman and Svoboda voted aye.  Tussing
                abstained.  Motion carried.

                  condition that no parking be permitted on West
                  Adams.  On call Steinman, Svoboda, Tussing and

The Clerk said the recommended date from the Assessor is Tuesday, July 15, 1997 at 2:30 p.m. The Chair recessed the Board of Equalization meeting until 2:30 p.m. The Chair reconvened the Board of Equalization meeting. 4) Removal of a tax exemption on real estate for South Gate United Methodist Church. The County Assessor recommended the tax exemption be denied for South Gate United Methodist Church because the property is being rented out beginning July 1, 1997. MOTION: Hudkins moved and Tussing seconded to accept the Assessor's recommendation and deny the tax exemption. On call Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried. 5) Denial of a tax exemption on real estate and personal property for Theta Chi Fraternity. The County Assessor recommended denial of the tax exemption because there is no educational use. MOTION: Tussing moved and Hudkins seconded to accept the Assessor's recommendation to deny the tax exemption because there is no educational use. On call Steinman, Svoboda, Tussing and Hudkins voted aye. Motion carried. 6) Approval of use for continued tax exemption for the Indian Center, Inc. (2 exemptions). The County Assessor explained both exemptions were filed late. The exemption on personal property has no penalty because it has completely depreciated. He recommended approval on the exemption for real estate with a late filing penalty of $100 per month for a total of $600. MOTION: Tussing moved and Svoboda seconded to accept the Assessor's recommendation to approve the exemption on personal property with no penalty and to approve the exemption on real estate with a late filing penalty. On call Svoboda, Tussing, Hudkins and Steinman voted aye. Motion carried. 7) Protest on real estate filed by the Indian Center, Inc. The Assessor explained the original value was $718,541 and stated he had reduced the value to $259,229 for 1997. He recommended the reduction of the value be approved. MOTION: Hudkins moved and Svoboda seconded to accept the Assessor's recommendation to reduce the value to $259,229 for 1997. On call Svoboda, Tussing, Hudkins and Steinman voted aye. Motion carried.
