1997 Regular Agendas & Minutes



Agenda for the regular Board of Commissioners meeting to be held in the County Commissioners Hearing Room, First Floor, County-City Building.
Tuesday, April 8, 1997 at 1:30 p.m.

 1) MINUTES:

     Approval of the minutes of the Board of Commissioners
     meeting held on Tuesday, April 1, 1997. (A copy of these
     minutes is on file in the Office of the Lancaster County
     Clerk.)

 2) CLAIMS:

     Approval of all claims processed through Tuesday, April 8,
     1997, with the exception that the vote of any Commissioner
     who might have a conflict of interest in the payment of any
     claim shall be deemed an abstention from approval for such
     claims alone.

 3) ITEMS OF PUBLIC PARTICIPATION:

     It is the policy of the Lancaster County Board of
     Commissioners to accommodate the public to the greatest
     extent possible.  Therefore, this agenda has been prepared
     with items of greatest public interest at the beginning with
     more routine items toward the end as a courtesy to those who
     wish to speak with the County Board at this meeting.  If you
     are here to participate on an item and need special
     consideration because of a schedule conflict or some other
     problem, would you please let us know now so we can try to
     meet your needs.

     *     A resolution proclaiming the week of April 13
           through April 19, 1997, as "National Crime
           Victims' Rights Week" (Resolution No. 5477).

 4) PUBLIC HEARINGS:

     A.   County Change of Zone Number 171, from AG Agricultural
          to R Residential, requested by Paul Weckle, on property
          located west of South 96th Street and north of Panama
          Road in Holland in Lancaster County, Nebraska
          (Resolution No. 5483).

     B.   An application for a Corporate Manager License for
          Jerry L. Sukup in connection with a Class K (Wine Off
          Sale Only) and a Class E (Beer Off Sale Only) liquor
          license for Whitehead Inc. dba/"U-Stop Convenience
          Shop" located at 6600 North 84th Street.


 5) NEW BUSINESS:

     A.   Applications for three Special Designated Licenses from
          the Nebraska State Board of Agriculture to hold the
          following:

          1.   A professional boxing match on Saturday, May 24,
               1997 from 6 p.m. to 1 a.m. at State Fair Park in
               the 4-H Building Arena.

          2.   Lincoln Area Street Rods - Summer Cruise '97 on
               Friday, May 30 through Sunday, June 1, 1997 from 9
               a.m. to 6 p.m. on Friday and Saturday and from
               Noon to 6 p.m. on Sunday at the attachment to the
               Food Plaza; and in a 50 foot by 75 foot area
               including open parking lots and an exhibit
               building located at State Fair Park.

     B.   A political subdivision tort claim filed against the
          Lancaster County Attention Center for Youth by Nghia T.
          Luong for lost property, in the amount of $50.

     C.   An economic development loan request, in the amount of
          $10,000, from KINCO Manufacturing Company to locate a
          heavy truck equipment and custom fabrication
          manufacturing plant within the corporate limits of
          Waverly, Nebraska.

     D.   A corporate manager application for Robert M. Shull in
          connection with a Class M (Bottle Club) and a Class K
          (Wine Off Sale Only) liquor license for Firethorn
          Investment, a Nebraska Partnership located at 9301
          Firethorn Lane, Lincoln, Lancaster County, Nebraska
          (Resolution No. 5484).

     E.   Approval of a lump sum settlement for Sarah Swanson for
          $12,000 in connection with a Workers Compensation
          claim.

     F.   Appointments of the following individuals to the
          Lincoln- Lancaster Women's Commission:

     H.   A recommendation from the Purchasing Agent to award a
          bid for a 1997 Dodge Grand Caravan for the Lancaster
          County  Corrections Department to Lincoln Dodge to be
          purchased through the State of Nebraska contract for
          $19,931.60.

     I.   A recommendation from the Purchasing Agent and the
          Lancaster County Sheriff's office to award a bid for
          eight new Crown Victoria Police Interceptor vehicles to
          H.P. Smith Ford to be purchased through the State of
          Nebraska contract for the total amount of $152,840.

     J.   A contract with The Hartford for Lancaster County
          employees, with amendments, reflecting changes in
          federal law.

     K.   A public performance license from Films Incorporated
          for the display of videotapes at the Lancaster County
          Correctional Facilities located in Airpark and at 605
          South 10th Street, for $783.75.

     L.   An application for public transportation assistance, in
          the amount of $27,924, for Lancaster County Rural
          Transit beginning on July 1, 1997 and ending June 30,
          1998.

     M.   Agreements with Butler, Dodge, Gage, Hall and Polk
          Counties to provide youth detention services at the
          Attention Center for Youth at the rate of $176.82 per
          day for each detainee, or at partial rates for 6-hour
          increments as specified in the contracts.

     N.   A contract between the Lancaster County Engineering
          Department and L.J. Webb Contractor, Inc. for concrete
          box culverts, in the amount of $192,157.70.

 6) CONSENT ITEMS:

     These are items of business before the Lancaster County
     Board of Commissioners which have been previously supplied
     to each Commissioner in writing, which are relatively
     routine and which are expected to be adopted without
     dissent.  Any individual item may be removed for special
     discussion and consideration by a Commissioner or by any
     member of the public without prior notice.  Unless there is
     an exception, these items will be approved as one with a
     single vote of the Board of Commissioners. These items are
     consideration of:

     A.   Monthly reports for the following:
          Lancaster County Clerk

          Lancaster County Engineering Department and the County
          Geographic Information System

          Lancaster County Records and Information Management

          Lancaster Manor

     B.   Setting of the following public hearings for Tuesday,
          April 22, 1997 at 1:30 p.m. in the Commissioners
          Hearing Room on the first floor of the County-City
          Building:

          1.   A change of location in connection with a Class E
               (Beer Off Sale Only) and a Class M (Bottle Club)
               liquor license for Dreamers Inc. dba/"BJ's
               Hideaway" to 1400 Saltillo Road in Lancaster
               County, Nebraska.

          2.   A street name change to name the new road located
               one- quarter mile south of Highway 2 between
               Nebraska Highway 43 east to South 162nd Street as
               "Luann Lane" (Street Name Change No. 97001).

     C.   Setting of a public hearing for Tuesday, April 29, 1997
          at 1:30 p.m. in the Commissioners Hearing Room on the
          first floor of the County-City Building for Final Plat
          No. 97006, Prairie Lake Estates, requested by Marvin
          Renner, consisting of nine residential lots, on
          property located east of South 54th Street between
          Firth and Gage Road in Lancaster County, Nebraska.

     D.   A user's agreement with Tony Davis for remote access to
          Lancaster County records at a rate of $.013 per
          transaction.

     E.   A service agreement for Property Management with
          O'Keefe Elevator Company, Inc. for maintenance of
          elevators located at the Community Mental Health
          Center, in the amount of $331, commencing April 1,
          1997.

     F.   Renewal of a service agreement for Records and
          Information Management with Microfilm Imaging Systems
          for $974.

     G.   Contracts between the Lancaster County Engineering
          Department and the following:

 7) ANNOUNCEMENTS:

     A.   The Lancaster County Board of Commissioners will hold a
          meeting on Thursday, April 10, 1997 at 8:30 a.m. in the
          Fourth Floor Conference Room of the County-City
          Building.

     B.   A Management Team Meeting will be held on Thursday,
          April 10, 1997 at 7:30 a.m., at the Police Department
          Building located at 233 South 10th Street.

     C.   A public hearing will be held on Tuesday, April 15,
          1997 at 1:30 p.m. in the Commissioners Hearing Room on
          the first floor of the County-City Building for County
          Change of Zone Number 165, from AG Agricultural to AGR
          Agricultural Residential, requested by Harry Muhlbach,
          on property located west of North 56th Street (Highway
          77) between Mill Road and Raymond Road in Lancaster
          County, Nebraska.

     D.   The Lancaster County Board of Commissioners will hold a
          meeting with Village Clerks on Thursday, April 24, 1997
          at 12:30 p.m. at the Lancaster County Extension
          Building in Room B located at 444 Cherrycreek Road to
          explore and discuss issue of mutual concern to Villages
          and the County.

     E.   The Lancaster County Board has scheduled an information
          meeting to prepare for changes in taxing powers
          contained in Legislative Bill 1114 (1996).  The meeting
          will be held on Thursday, April 24, 1997 at 7 p.m. in
          the Commissioners Hearing Room on the first floor of
          the County-City Building, 555 South 10th Street,
          Lincoln, Nebraska.

     F.   The Lancaster County Board of Commissioners meeting
          which is broadcast live at 1:30 p.m. on Tuesdays will
          be re- broadcast at 6:30 p.m. on Cablevision Channel 5.

 8) EMERGENCY ITEMS AND OTHER BUSINESS:

 9) PENDING:

     A.   Comprehensive Plan Amendment Number 15 revising the
          Lincoln Land Use Plan to change an 18-acre area at the
          southwest corner of 56th Street and Pine Lake Road from
          Residential to Commercial (Resolution Number 5457).

     B.   Change of Zone Number 147, from AG Agricultural to AGR
          Agricultural Residential, requested by Peter W. Katt on
          behalf of Steve Champoux, on property located at the
          northwest corner of 134th and "A" Streets in Lancaster
          County, Nebraska.

     C.   County Change of Zone Number 139, requested by Leroy F.
          Busboom, from AG Agriculture to AGR Agricultural
          Residential, on property located at the northeast
          corner of Southwest 112th Street and West Pioneers
          Boulevard in Lancaster County, Nebraska (Resolution No.
          5479).  (This item is scheduled for further discussion
          on Tuesday, April 15, 1997.)

     JoAnna Svoboda of the Lincoln Police Department's Victim
     Witness Unit, appeared and gave a brief presentation
     regarding victim's rights.

     Steinman read Resolution Number 5477 into the record.

     MOTION:   Tussing moved and Svoboda seconded approval.  On
               call Steinman, Svoboda, Tussing, Campbell and
               Hudkins voted aye.  Motion carried.


 4) PUBLIC HEARINGS:

     A.   County Change of Zone Number 171, from AG Agricultural
          to R Residential, requested by Paul Weckle, on property
          located west of South 96th Street and north of Panama
          Road in Holland in Lancaster County, Nebraska
          (Resolution No. 5483).

          Steinman opened the public hearing and asked if anyone
          wished to appear in favor of the change of zone.

          Paul Weckle, applicant, appeared and said he had met
          with Sanitary Improvement District 3 to address some of
          their concerns and as a result he said he has amended
          his plan. Documentation was distributed regarding the
          amendment (Exhibit "A").  He explained he would now
          like to create four lots out of Lot 71 which contains
          approximately 9.4 acres. Weckle said he has decided to
          put in his own lagoon to ease the pressure regarding
          concerns about sewer services and that Lot 3 would also
          have its own opportunity to put in a lagoon. He noted
          Lots 1 and 2 have been a part of the Sanitary
          Improvement District for many years.

          Steinman asked if anyone wished to testify in
          opposition or in a neutral position.

          No one appeared.

          Campbell said they would need to go through the
          preliminary plat process.

          Mike DeKalb, Planning Department, said that was
          correct.  He explained the net lot size is slightly
          under ten acres and the subdivision regulations require
          any parcel created under ten acres in size to have
          subdivision approval.

          Steinman closed the public hearing.

          MOTION:   Tussing moved and Hudkins seconded approval
                    of Resolution Number 5483.  On call Svoboda,
                    Tussing, Campbell, Hudkins and Steinman voted
                    aye.  Motion carried.

     B.   An application for a Corporate Manager License for

          The Clerk swore in Steve Mann, concerned citizen.

          Mann stated he supported the application and addressed
          his concerns about children and alcohol.

          The Clerk swore in Jerry Sukup, applicant.

          Sukup stated he would be happy to answer any questions
          the Board may have.

          Steinman asked if anyone wished to testify in
          opposition or in a neutral position.

          No one appeared and Steinman closed the public hearing.

          Steinman noted action on the item would be taken next
          Tuesday, April 15, 1997.


 5) NEW BUSINESS:

     A.   Applications for three Special Designated Licenses from

               In response to a question asked by Tussing,
               Schrock stated they do have a fenced area in front
               of the plaza.

               MOTION:   Campbell moved and Hudkins seconded
                         approval.  On call Hudkins, Steinman,
                         Campbell, Svoboda and Tussing voted aye.
                         Motion carried.

     B.   A political subdivision tort claim filed against the
          Lancaster County Attention Center for Youth by Nghia T.
          Luong for lost property, in the amount of $50.

          Nghia Luong, claimant, appeared and indicated staff at
          the Attention Center had placed his property into other
          individuals accounts.

          Campbell noted the recommendation was for approval in
          the amount of $40.

          Hudkins asked Luong if the calling card had been
          cancelled.

          Luong stated it was a prepaid card for $10.

          Hudkins stated he felt they should approve the claim
          for $50 in light of the information regarding the
          prepaid calling card.

          MOTION:   Hudkins moved and Campbell seconded to
                    approve the tort claim for $50.  On call
                    Svoboda, Campbell, Tussing, Hudkins and
                    Steinman voted aye.  Motion carried.

     C.   An economic development loan request, in the amount of
          $10,000, from KINCO Manufacturing Company to locate a
          heavy truck equipment and custom fabrication
          manufacturing plant within the corporate limits of
          Waverly, Nebraska.

          MOTION:   Campbell moved and Hudkins seconded approval.

          Carole Eddins, City Urban Development Department,
          appeared and reported she had contacted each member of
          the loan committee who voted five to zero to recommend
          approval to the County Board.  She added there is a
          need for an  interlocal agreement between the County
          and the City of Waverly.

          ROLL CALL:     Campbell, Svoboda, Steinman, Tussing and
                         Hudkins voted aye.  Motion carried.

          MOTION:   Campbell moved and Hudkins seconded to
                    request the County Attorney's office, in
                    consultation with the Chief Administrative
                    Officer and Economic Development, to develop
                    an interlocal agreement with the City of
                    Waverly and other cities.  On call Hudkins,
                    Svoboda, Tussing, Steinman and Campbell voted
                    aye.  Motion carried.

     D.   A corporate manager application for Robert M. Shull in
          connection with a Class M (Bottle Club) and a Class K
          (Wine Off Sale Only) liquor license for Firethorn
          Investment, a Nebraska Partnership located at 9301
          Firethorn Lane, Lincoln, Lancaster County, Nebraska
          (Resolution No. 5484).

          MOTION:   Tussing moved and Svoboda seconded approval.

          Campbell stated she would like to hold the item for one
          week and request Shull to appear on Tuesday, April 15,
          1997.

          Tussing withdrew her motion.

          MOTION:   Campbell moved and Hudkins seconded to hold
                    the application for one week and request
                    Shull to appear before the Board.  On call
                    Campbell, Hudkins, Steinman, Svoboda and
                    Tussing voted aye.  Motion carried.

     E.   Approval of a lump sum settlement for Sarah Swanson for
          $12,000 in connection with a Workers Compensation
          claim.

          Diane Staab, Deputy County Attorney, appeared and said
          the Safety and Training Officer and Doug Cyr, Deputy
          County Attorney, had recommended approval of the claim.
          She noted the claim was in connection with an employee
          at Lancaster Manor.

          MOTION:   Tussing moved and Campbell seconded approval.
                    On call Svoboda, Hudkins, Tussing, Steinman
                    and Campbell voted aye.  Motion carried.

     F.   Appointments of the following individuals to the
          Lincoln- Lancaster Women's Commission:

          the amount of $27,924, for the Lancaster County Rural
          Transit beginning on July 1, 1997 and ending June 30,
          1998.

          Tim Howell, Lincoln Area Agency on Aging, appeared and
          said the $27,924 was the Federal and State portion.
          The County's share would be $18,133.

          MOTION:   Hudkins moved and Tussing seconded approval.
                    On call Campbell, Steinman, Svoboda, Hudkins
                    and Tussing voted aye.  Motion carried.

1) MINUTES:

     Approval of the minutes of the Board of Equalization meeting
     held on Tuesday, April 1, 1997. (A copy of these minutes is
     on file in the Office of the Lancaster County Clerk.)

     MOTION:   Hudkins moved and Tussing seconded approval.  On
               call Campbell, Hudkins, Steinman, Svoboda and
               Tussing voted aye.  Motion carried.


2) ADDITIONS AND DEDUCTIONS:

     Approval of 26 additions and deductions to the tax
     assessment rolls per Exhibit "A".

     MOTION:   Tussing moved and Campbell seconded approval.  On
               call Hudkins, Steinman, Svoboda, Tussing and
               Campbell voted aye.  Motion carried.


3) MOTOR VEHICLE TAX EXEMPTIONS:

     Family Service
     St. Thomas Aquinas Church

     MOTION:   Tussing moved and Campbell seconded to deny the
               motor vehicle tax exemption for Family Service
               because it was not timely filed.  On call
               Steinman, Svoboda, Tussing, Campbell and Hudkins
               voted aye.  Motion carried.

     MOTION:   Tussing moved and Hudkins seconded to approve a
               motor vehicle tax exemption for St. Thomas Aquinas
               Church.  On call Svoboda, Tussing, Campbell,
               Hudkins and Steinman voted aye.  Motion carried.

     Steinman recessed the Board of Equalization.

     Steinman reconvened the Board of Equalization.

4)   Tax exemptions filed on personal property and real estate
     which were filed after the January 1, 1997 deadline:

     First Lutheran Church
     Fredrick Ozanan Building Corp

     The exemption for Capital Soccer Association was withdrawn
     because they have no personal property.

     MOTION:   Campbell moved and Tussing seconded to accept the
               County Assessor's recommendation to approve late
               filing penalties for Capital Soccer Association,
               Cedars Home Foundation, Inc (2 exemptions), Cedars
               Inc., Downtown Lincoln Foundation, Fredrick Ozanan
               Building Corp, House of Hope of Nebraska, Inc.
               International Church of the Foursquare, Lebanon
               Lodge #3 and Warren United Methodist Church and to
               withdraw the exemption for First Lutheran Church.
               On call Campbell, Hudkins, Steinman, Svoboda and
               Tussing voted aye.  Motion carried.

5)   Appeals filed on real estate for years 1994 through 1996 for
     the following:

     Young Men's Christian Association

     Norm Agena, Lancaster County Assessor, recommended the value
     be reduced to zero for 1994, 1995 and 1996.  He explained
     for 1997 a value would be put on the property since it has
     been developed into four buildable lots.

     MOTION:   Campbell moved and Tussing seconded to accept the
               County Assessor's recommendation and reduce the
               value to zero for 1994, 1995 and 1996.  On call
               Hudkins, Steinman, Svoboda, Tussing and Campbell
               voted aye.  Motion carried.

     Gene L. and Sandra J. Kalvelage

     Agena explained that in 1993, prior to the 1994 reappraisal,
     there were two houses sitting on the lot.  One with an
     address of South 1st Street and the other with an address of
     112 "K" Street with a total value for both houses of
     approximately $24,000.  In 1994, when the reappraisal was
     completed,  one of the houses was inadvertently left off.
     Agena explained the error was found a few months ago and the
     other house was put back on for 1994, 1995 and 1996 which
     increased the value from $17,600 to $30,300.

     MOTION:   Tussing moved and Campbell seconded to accept the
               County Assessor's recommendation and deny the
               appeal filed on real estate by Gene L. and Sandra
               J. Kalvelage.  On call Steinman, Svoboda, Tussing,
               Campbell and Hudkins voted aye.  Motion carried.
