1) MINUTES: Approval of the minutes of the Board of Commissioners meeting held on Tuesday, March 11, 1997. (A copy of these minutes is on file in the Office of the Lancaster County Clerk.) 2) CLAIMS: Approval of all claims processed through Tuesday, March 18, 1997, with the exception that the vote of any Commissioner who might have a conflict of interest in the payment of any claim shall be deemed an abstention from approval for such claims alone. 3) ITEMS OF PUBLIC PARTICIPATION: It is the policy of the Lancaster County Board of Commissioners to accommodate the public to the greatest extent possible. Therefore, this agenda has been prepared with items of greatest public interest at the beginning with more routine items toward the end as a courtesy to those who wish to speak with the County Board at this meeting. If you are here to participate on an item and need special consideration because of a schedule conflict or some other problem, would you please let us know now so we can try to meet your needs. 4) PUBLIC HEARINGS: A. Continuation of request from Todd Lewis to validate five warranty deeds (Instrument Numbers 95-10975, 95-12179, 95- 10976, 95-10977 and 95-12180). B. County Change of Zone No. 165, from AG Agricultural to AGR Agricultural Residential, requested by Harry Muhlbach, on property located west of North 56th (Hwy 77) between Mill Road and Raymond Road in Lancaster County, Nebraska (Resolution Number 5468). C. County Change of Zone No. 169, from "I" Industrial and "R" Residential to "B" Business, requested by Todd Wicken, on property located at the northeast corner of Highway 77 (South 12th) and Broad Street in Princeton, Lancaster County, Nebraska (Resolution Number 5469). D. County Change of Zone No. 170, from AG Agricultural to AGR Agricultural Residential, requested by Lawrence Conway, on property located approximately one-quarter of a mile west of U.S. Highway No. 77, on the north side of Panama Road in Lancaster County, Nebraska (Resolution Number 5470). 5) NEW BUSINESS: A. Application for a Class E (Beer Off Sale Only) and a Class M (Bottle Club) liquor license for Todd Hoyer and Cindy Wohl dba/The Kramer Bar (formerly known as the J & C Country Bar and Grill) located in Kramer, Lancaster County, Nebraska (Resolution Number 5471). B. An amendment to a food service contract between Lancaster County and AraMark Correctional Services, Inc. for an increase in the cost per-meal from $1.09 to $1.124 for the Corrections Department and Cornhusker Place and from $1.22 to $1.258 for the Attention Center for Youth, commencing on March 1, 1997 and ending February 28, 1998. C. Approval of a lump sum settlement, in the amount of $3,000, in connection with Pamela Johnson's workers' compensation claim. D. A recommendation from the Purchasing Agent and the Lancaster County Engineer to award a bid to furnish all labor and materials for the construction of Westgate paving to Pavers LLC, for $28,412.06. E. A recommendation from the Purchasing Agent and the Lancaster County Engineer to award a bid to L.J. Webb Constructors, Inc., for $192,157.70, to provide labor and materials for the construction of concrete box culverts at various locations in Lancaster County, Nebraska. F. A contract between the Lancaster County Sheriff's office and LTR Towing to provide towing, storage of towed vehicles and other related services at rates as outlined in the contract. This contract commences on April 1, 1997 and ends on March 31, 2001. G. An agreement between Lancaster County and the City of Lincoln dba/Lincoln General Hospital, for the conveyance of real property to create additional parking on the Lincoln General Hospital Campus, with net consideration to Lancaster County of approximately $74,925. 6) CONSENT ITEMS: These are items of business before the Lancaster County Board of Commissioners which have been previously supplied to each Commissioner in writing, which are relatively routine and which are expected to be adopted without dissent. Any individual item may be removed for special discussion and consideration by a Commissioner or by any member of the public without prior notice. On call Campbell, Hudkins, Steinman, Svoboda and Tussing voted aye. Motion carried. 3) The Clerk asked if anyone present requested a change in the agenda. No requests were made and the meeting proceeded as planned. 4) PUBLIC HEARINGS: A. Continuation of request from Todd Lewis to validate five warranty deeds (Instrument Numbers 95-10975, 95-12179, 95- 10976, 95-10977 and 95-12180). Steinman reconvened the public hearing. Don Dunn, attorney representing Todd Lewis, appeared and explained a dispute had arisen on whether five warranty deeds are valid because at the time of filing a portion of property was conveyed which was smaller than what is now permitted by the subdivision ordinance. In November of 1977, Dunn said, the predecessor of title (Mr. Lewis' father) had the property surveyed and it was broken into seven separate parcels, one of which was immediately deeded off. The survey was then filed with the County. The recollection of Mr. Lewis' father was that deeds were prepared at that time for each parcel. In 1995 the property was deeded in individual tract descriptions by separate warranty deed to Todd Lewis. Dunn said the issue was whether or not the creation of the survey and the filing of the survey with the County is enough to create a "division of property". In response to a question asked by Campbell, Dunn said Lewis' father was living in a farmhouse on the tract of land when a flood occurred and records were lost which he believes included the deeds. Hudkins asked if the title company which prepared the deeds remains in business. Dunn replied that the company remains in business and they have searched their files and found nothing. Steinman asked if anyone wished to appear in opposition. Robert Avey, Assistant Attorney General for the State of Nebraska appearing on behalf of the Department of Roads, appeared and said the Department of Roads is opposed to the validation of the warranty deeds. He pointed out that the deeds were transferred by Lewis' father in the middle of a lawsuit with the Department of Roads. He said he felt the deeds should be produced or the title company should come forth with an affidavit to show the deeds were created. Diane Staab, Deputy County Attorney, appeared and said it was a discretionary function of the Board as to whether they want to object to the validation of the deeds. She said it is the belief of the County Attorney's office that the filing of a survey in the County Engineer's office is not enough to grandfather the property. Staab added nothing was filed with the Register of Deeds office until 1995. Steinman closed the public hearing. MOTION: Tussing moved and Campbell seconded to direct the County Attorney's office to prepare a resolution denying the request and contesting the validation of the warranty deeds. On call Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye. Motion carried. B. Steinman opened the public hearing and asked if anyone wished to speak in favor of the zoning change. Michael Rierden, attorney appearing on behalf of Harry Muhlbach, asked for a 30 day continuance because studies regarding the availability and quality of water have not been completed. Steinman asked if anyone wished to speak in opposition or in a neutral position. No one appeared and Steinman closed the public hearing. MOTION: Campbell moved and Hudkins seconded to reopen the public hearing in 30 days at the request of the applicant. On call Svoboda, Tussing, Campbell, Hudkins and Steinman voted aye. Motion carried. C. County Change of Zone No. 169, from "I" Industrial and "R" Residential to "B" Business, requested by Todd Wicken, on property located at the northeast corner of Highway 77 (South 12th) and Broad Street in Princeton, Lancaster County, Nebraska (Resolution Number 5469). Steinman opened the public hearing and asked if anyone wished to testify in favor, opposition or in a neutral position. No one appeared in favor or opposition. Mike DeKalb, Planning Department, appeared in a neutral position and indicated the Health Department raised a number of issues of concern regarding groundwater. He added Planning staff recommendation was for approval cognizant of the issues regarding sewage disposal and water. Planning Commission also recommended approval. Campbell said she feels the Health Department is trying to raise the concern of everyone and would continue to raise issues regarding sewage disposal and water with anything that comes into precedence; it's not specific to the application before the Board at the present time. Steinman closed the public hearing. MOTION: Campbell moved and Hudkins seconded approval. On call Tussing, Campbell, Hudkins, Steinman and Svoboda voted aye. Motion carried. D. County Change of Zone No. 170, from AG Agricultural to AGR Agricultural Residential, requested by Lawrence Conway, on property located approximately one-quarter of a mile west of U.S. Highway No. 77, on the north side of Panama Road in Lancaster County, Nebraska (Resolution Number 5470). Steinman opened the public hearing and asked if anyone wished to speak in favor of the zoning change. Lawrence Conway, applicant, appeared and said he wanted to fulfill a promise he made to his daughter that she could have the property in order to build a home upon. He added they have an excellent irrigation well and believes the most efficient and best use of the land is for a house. Conway also spoke about the issue of clustering and indicated he opposes the idea. Steinman asked if anyone wished to testify in opposition or in a neutral position. No one appeared. Steinman closed the public hearing. MOTION: Tussing moved and Campbell seconded to deny Change of Zone Number 170. On call Campbell, Hudkins, Steinman, Svoboda and Tussing voted aye. MOTION: Tussing moved and Campbell seconded approval to accept the Assessor's recommendation and deny the exemptions for Bryan Memorial Hospital, Lincoln Education Association, Mercy Northglen, Mercy Western Manor, Nebraska Wesleyan University (2 exemptions), Saint Paul United Methodist Church, Star City Youth Foundation, American Lutheran Church, American National Red Cross, Catholic Bishop of Lincoln (3 exemptions), Christ Lutheran Church, Food Bank of Lincoln, Nebraska Conference of United Methodist Church, Neighborhood Housing Services and Young Mens Christian Association.
