1997 Regular Agendas & Minutes



Agenda for the regular Board of Commissioners meeting to be held in the County Commissioners Hearing Room, First Floor, County-City Building.
Tuesday, March 18, 1997 at 1:30 p.m.

 1) MINUTES:

     Approval of the minutes of the Board of Commissioners
     meeting held on Tuesday, March 11, 1997. (A copy of these
     minutes is on file in the Office of the Lancaster County
     Clerk.)

 2) CLAIMS:

     Approval of all claims processed through Tuesday, March 18,
     1997, with the exception that the vote of  any Commissioner
     who might have a conflict of interest in the payment of any
     claim shall be deemed an abstention from approval for such
     claims alone.

 3) ITEMS OF PUBLIC PARTICIPATION:

     It is the policy of the Lancaster County Board of
     Commissioners to accommodate the public to the greatest
     extent possible.  Therefore, this agenda has been prepared
     with items of greatest public interest at the beginning with
     more routine items toward the end as a courtesy to those who
     wish to speak with the County Board at this meeting.  If you
     are here to participate on an item and need special
     consideration because of a schedule conflict or some other
     problem, would you please let us know now so we can try to
     meet your needs.

 4) PUBLIC HEARINGS:

     A.   Continuation of request from Todd Lewis to validate
          five warranty deeds (Instrument Numbers 95-10975, 95-12179,
	  95- 10976, 95-10977 and 95-12180).

     B.   County Change of Zone No. 165, from AG Agricultural to
          AGR Agricultural Residential, requested by Harry
          Muhlbach, on property located west of North 56th (Hwy
          77) between Mill Road and Raymond Road in Lancaster
          County, Nebraska  (Resolution Number 5468).

     C.   County Change of Zone No. 169, from "I" Industrial and
          "R" Residential to "B" Business, requested by Todd
          Wicken, on property located at the northeast corner of
          Highway 77 (South 12th) and Broad Street in Princeton,
          Lancaster County, Nebraska (Resolution Number 5469).

     D.   County Change of Zone No. 170, from AG Agricultural to
          AGR Agricultural Residential, requested by Lawrence
          Conway, on property located approximately one-quarter
          of a mile west of U.S. Highway No. 77, on the north
          side of Panama Road in Lancaster County, Nebraska
          (Resolution Number 5470).

 5) NEW BUSINESS:

     A.   Application for a Class E (Beer Off Sale Only) and a
          Class M (Bottle Club) liquor license for Todd Hoyer and
          Cindy Wohl dba/The Kramer Bar (formerly known as the J
          & C Country Bar and Grill) located in Kramer, Lancaster
          County, Nebraska (Resolution Number 5471).

     B.   An amendment to a food service contract between
          Lancaster County and AraMark Correctional Services,
          Inc. for an increase in the cost per-meal from $1.09 to
          $1.124 for the Corrections Department and Cornhusker
          Place and from $1.22 to $1.258 for the Attention Center
          for Youth, commencing on   March 1, 1997 and ending
          February 28, 1998.

     C.   Approval of a lump sum settlement, in the amount of
          $3,000, in connection with Pamela Johnson's workers'
          compensation claim.

     D.   A recommendation from the Purchasing Agent and the
          Lancaster County Engineer to award a bid to furnish all
          labor and materials for the construction of Westgate
          paving to Pavers LLC, for $28,412.06.

     E.   A recommendation from the Purchasing Agent and the
          Lancaster County Engineer to award a bid to L.J. Webb
          Constructors, Inc., for $192,157.70, to provide labor
          and materials for the construction of concrete box
          culverts at various locations in Lancaster County,
          Nebraska.

     F.   A contract between the Lancaster County Sheriff's
          office and LTR Towing to provide towing, storage of
          towed vehicles and other related services at rates as
          outlined in the contract. This contract commences on
          April 1, 1997 and ends on March 31, 2001.

     G.   An agreement between Lancaster County and the City of
          Lincoln dba/Lincoln General Hospital, for the
          conveyance of real property to create additional
          parking on the Lincoln General Hospital Campus, with
          net consideration to Lancaster County of approximately
          $74,925.


 6) CONSENT ITEMS:

     These are items of business before the Lancaster County
     Board of Commissioners which have been previously supplied
     to each Commissioner in writing, which are relatively
     routine and which are expected to be adopted without
     dissent.  Any individual item may be removed for special
     discussion and consideration by a Commissioner or by any
     member of the public without prior notice.  Unless there is
     an exception, these items will be approved as one with a
     single vote of the Board of Commissioners. These items are
     consideration of:

     A.   Monthly reports for the following:

          Lancaster County Noxious Weed Control Authority and the
          Combined Weed Control Program for the City of Lincoln

          Lancaster County Register of Deeds

     B.   Setting of a public hearing for Tuesday, April 1, 1997
          at 1:30 p.m. in the Commissioners Hearing Room, First
          Floor, County-City Building regarding a manager
          application for Robert M. Shull in connection with a
          Class M (Bottle Club) and a Class K (Wine Off Sale
          Only) liquor license for Firethorn Investment, a
          Nebraska Partnership.

     C.   A request for refund of motor vehicle taxes, for
          $58.92, from Terry and Chris Neemann because the
          vehicle was assessed in the wrong taxing district.

     D.   Renewal of maintenance agreements for the following:

 7) ANNOUNCEMENTS:

     A.   A Lancaster County Leasing Corporation meeting will be
          held immediately following the County Board meeting on
          Tuesday, March 18, 1997 in the Commissioners Hearing
          Room, First Floor, County-City Building.

     B.   Public hearings will be heard on Tuesday, March 25,
          1997 at 1:30 p.m. in the County Commissioners Hearing
          Room, First Floor, County-City Building regarding the
          following:

          1.   County Special Permit No. 140, Osage Acres
               Community Unit Plan, requested by Design
               Associates for Stewart Farms, LTD., consisting of
               nine single family lots and two  outlots, on

     A.   Comprehensive Plan Amendment Number 15 revising the
          Lincoln Land Use Plan to change an 18-acre area at the
          southwest corner of 56th Street and Pine Lake Road from
          Residential to Commercial (Resolution Number 5457).

     B.   Change of Zone Number 147, from AG Agricultural to AGR
          Agricultural Residential, requested by Peter W. Katt on
          behalf of Steve Champoux, on property located at the
          northwest corner of 134th and "A" Streets in Lancaster
          County, Nebraska.

10) ADJOURNMENT:

     Approval of the minutes of the Board of Commissioners

     MOTION:    Tussing moved and Campbell seconded approval.
                On call Campbell, Hudkins, Steinman, Svoboda
                and Tussing voted aye.  Motion carried.

 3)  The Clerk asked if anyone present requested a change in the
     agenda.  No requests were made and the meeting proceeded as
     planned.


 4) PUBLIC HEARINGS:

     A.   Continuation of request from Todd Lewis to validate
          five warranty deeds (Instrument Numbers 95-10975, 95-12179,
	  95- 10976, 95-10977 and 95-12180).

          Steinman reconvened the public hearing.

          Don Dunn, attorney representing Todd Lewis, appeared
          and explained a dispute had arisen on whether five
          warranty deeds are valid because at the time of filing
          a portion of property was conveyed which was smaller
          than what is now permitted by the subdivision
          ordinance.

          In November of 1977, Dunn said, the predecessor of
          title (Mr. Lewis' father) had the property surveyed and
          it was broken into seven separate parcels, one of which
          was immediately deeded off.  The survey was then filed
          with the County.  The recollection of Mr. Lewis' father
          was that deeds were prepared at that time for each
          parcel.  In 1995 the property was deeded in individual
          tract descriptions by separate warranty deed to Todd
          Lewis.

          Dunn said the issue was whether or not the creation of
          the survey and the filing of the survey with the County
          is enough to create a "division of property".

          In response to a question asked by Campbell, Dunn said
          Lewis' father was living in a farmhouse on the tract of
          land when a flood occurred and records were lost which
          he believes included the deeds.

          Hudkins asked if the title company which prepared the
          deeds remains in business.

          Dunn replied that the company remains in business and
          they have searched their files and found nothing.

          Steinman asked if anyone wished to appear in
          opposition.

          Robert Avey, Assistant Attorney General for the State
          of Nebraska appearing on behalf of the Department of
          Roads, appeared and said the Department of Roads is
          opposed to the validation of the warranty deeds.  He
          pointed out that the deeds were transferred by  Lewis'
          father in the middle of a lawsuit with the Department
          of Roads.  He said he felt the deeds should be produced
          or the title company should come forth with an
          affidavit to show the deeds were created.

          Diane Staab, Deputy County Attorney, appeared and said
          it was a discretionary function of the Board as to
          whether they want to object to the validation of the
          deeds.  She said it is the belief of the County
          Attorney's office that the filing of a survey in the
          County Engineer's office is not enough to grandfather
          the property.  Staab added nothing was filed with the
          Register of Deeds office until 1995.

          Steinman closed the public hearing.

          MOTION:    Tussing moved and Campbell seconded to
                     direct the County Attorney's office to
                     prepare a resolution denying the request
                     and contesting the validation of the
                     warranty deeds.  On call Steinman,
                     Svoboda, Tussing, Campbell and Hudkins
                     voted aye.  Motion carried.

     B.   County Change of Zone No. 165, from AG Agricultural to
          AGR Agricultural Residential, requested by Harry
          Muhlbach, on property located west of North 56th (Hwy
          77) between Mill Road and Raymond Road in Lancaster
          County, Nebraska  (Resolution Number 5468).

          Steinman opened the public hearing and asked if anyone
          wished to speak in favor of the zoning change.

          Michael Rierden, attorney appearing on behalf of Harry
          Muhlbach, asked for a 30 day continuance because
          studies regarding the availability and quality of water
          have not been completed.

          Steinman asked if anyone wished to speak in opposition
          or in a neutral position.

          No one appeared and Steinman closed the public hearing.

          MOTION:    Campbell moved and Hudkins seconded to
                     reopen the public hearing in 30 days at
                     the request of the applicant.  On call
                     Svoboda, Tussing, Campbell, Hudkins and
                     Steinman voted aye.  Motion carried.

     C.   County Change of Zone No. 169, from "I" Industrial and
          "R" Residential to "B" Business, requested by Todd
          Wicken, on property located at the northeast corner of
          Highway 77 (South 12th) and Broad Street in Princeton,
          Lancaster County, Nebraska (Resolution Number 5469).

          Steinman opened the public hearing and asked if anyone
          wished to testify in favor, opposition or in a neutral
          position.

          No one appeared in favor or opposition.

          Mike DeKalb, Planning Department, appeared in a neutral
          position and indicated the Health Department raised a
          number of issues of concern regarding groundwater.  He
          added Planning staff recommendation was for approval
          cognizant of the issues regarding sewage disposal and
          water.  Planning Commission also recommended approval.

          Campbell said she feels the Health Department is trying
          to raise the concern of everyone and would continue to
          raise issues regarding sewage disposal and water with
          anything that comes into precedence; it's not specific
          to the application before the Board at the present
          time.

          Steinman closed the public hearing.

          MOTION:    Campbell moved and Hudkins seconded
                      approval.  On call Tussing, Campbell,
                      Hudkins, Steinman and Svoboda voted aye.
                      Motion carried.

     D.   County Change of Zone No. 170, from AG Agricultural to
          AGR Agricultural Residential, requested by Lawrence
          Conway, on property located approximately one-quarter
          of a mile west of U.S. Highway No. 77, on the north
          side of Panama Road in Lancaster County, Nebraska
          (Resolution Number 5470).

          Steinman opened the public hearing and asked if anyone
          wished to speak in favor of the zoning change.

          Lawrence Conway, applicant, appeared and said he wanted
          to fulfill a promise he made to his daughter that she
          could have the property in order to build a home upon.
          He added they have an excellent irrigation well and
          believes the most efficient and best use of the land is
          for a house.  Conway also spoke about the issue of
          clustering and indicated he opposes the idea.

          Steinman asked if anyone wished to testify in
          opposition or in a neutral position.

          No one appeared.

          Steinman closed the public hearing.

          MOTION:    Tussing moved and Campbell seconded to
                     deny Change of Zone Number 170.  On call
                     Campbell, Hudkins, Steinman, Svoboda and
                     Tussing voted aye.  Motion carried.

          MOTION:    Campbell moved Tussing seconded approval
                     with changed amount of $67,483.  On call
                     Steinman, Svoboda, Tussing, Campbell and
                     Hudkins voted aye. Motion carried.

          County, Nebraska.

     D.   The Lancaster County Board of Commissioners will hold a
          meeting on Thursday, March 20, 1997 at 8:30 a.m. in the
          Fourth Floor Conference Room, County-City Building.

     E.   The Lancaster County Board of Commissioners meeting
          which is broadcast live at 1:30 p.m. on Tuesdays will
          be re- broadcast at 6:30 p.m. on Cablevision Channel 5.

          Discussion followed regarding the issue of the length
          of time an agenda item may be on "Pending".

          Campbell suggested any future items which may be placed
          on pending be for a date certain.

1) MINUTES:

     Approval of the minutes of the Board of Equalization meeting
     held on Tuesday, March 11, 1997. (A copy of these minutes is
     on file in the Office of the Lancaster County Clerk.)

     MOTION:    Hudkins moved and Tussing seconded approval.
                On call Campbell, Hudkins, Steinman, Svoboda
                and Tussing voted aye.  Motion carried.


2) ADDITIONS AND DEDUCTIONS:

     Approval of 103 additions and deductions to the tax
     assessment rolls per Exhibit "A".

     MOTION:    Hudkins moved and Campbell seconded approval.
                On call Hudkins, Steinman, Svoboda, Tussing
                and Campbell voted aye.  Motion carried.


3) MOTOR VEHICLE TAX EXEMPTIONS:

     Berean Fundamental Church of Lincoln, Nebraska
     Catholic Social Services
     City Impact
     Developmental Services of Nebraska, Inc.
     Nebraska Conference of the United Methodist Church
     Redeemer Lutheran Church
     Union College

     MOTION:    Tussing moved and Hudkins seconded approval
                of motor vehicle tax exemptions for Redeemer
                Lutheran Church, City Impact, Catholic Social
                Services, Developmental Services of Nebraska,
                Inc. and Union College and approval of motor
                vehicle tax exemptions subject to the vehicle
                being title and registered to the applicant
                for Nebraska Conference of the United
                Methodist Church and Berean Fundamental
                Church of Lincoln, Nebraska.  On call
                Steinman, Svoboda, Tussing, Campbell and
                Hudkins voted aye.  Motion carried.

     Steinman recessed the Board of Equalization until 2:30 p.m.

     Steinman reconvened the Board of Equalization at 2:30 p.m.

4)   Partial Exemptions on Real Estate and Personal Property for
     1997 per Exhibit "B".

     MOTION:    Campbell moved and Tussing seconded to accept
                the Assessor's recommendation and approve
                partial exemptions for Nebraska District of
                the Lutheran Church Missouri Synod and
                Planned Parenthood of Lincoln.  On call
                Campbell, Hudkins, Steinman, Svoboda and
                Tussing voted aye.  Carried.


5)   Denied Exemptions on Real Estate and Personal Property for
     1997 per Exhibit "C".

     Campbell noted for the record that she is a member of the
     Board of Directors for the Food Bank of Lincoln.

     MOTION:    Tussing moved and Campbell seconded approval
                to accept the Assessor's recommendation and
                deny the exemptions for Bryan Memorial
                Hospital, Lincoln Education Association,
                Mercy Northglen, Mercy Western Manor,
                Nebraska Wesleyan University (2 exemptions),
                Saint Paul United Methodist Church, Star City
                Youth Foundation, American Lutheran Church,
                American National Red Cross, Catholic Bishop
                of Lincoln (3 exemptions), Christ Lutheran
                Church, Food Bank of Lincoln, Nebraska
                Conference of United Methodist  Church,
                Neighborhood Housing Services and Young Mens
                Christian Association.  On call Hudkins,
                Steinman, Svoboda, Tussing and Campbell voted
                aye.  Motion carried.
