1997 Regular Agendas & Minutes



Agenda for the regular Board of Commissioners meeting to be held in the County Commissioners Hearing Room, First Floor, County-City Building.
Tuesday, March 4, 1997 at 1:30 p.m.

1) MINUTES:

     Approval of the minutes of the Board of Commissioners
     meeting held on Tuesday, February 25, 1997. (A copy of these
     minutes is on file in the Office of the Lancaster County
     Clerk.)

2) CLAIMS:

     Approval of all claims processed through Tuesday, March 4,
     1997, with the exception that the vote of any Commissioner
     who might have a conflict of interest in the payment of any
     claim shall be deemed an abstention from approval for such
     claims alone.

3) ITEMS OF PUBLIC PARTICIPATION:

     It is the policy of the Lancaster County Board of
     Commissioners to accommodate the public to the greatest
     extent possible.  Therefore, this agenda has been prepared
     with items of greatest public interest at the beginning with
     more routine items toward the end as a courtesy to those who
     wish to speak with the County Board at this meeting.  If you
     are here to participate on an item and need special
     consideration because of a schedule conflict or some other
     problem, would you please let us know now so we can try to
     meet your needs.

     *     Presentation of the Care Force Award to Gayle
           Mandeville for her services with the Lancaster
           County Attention Center.

4) PUBLIC HEARINGS:

     A.   A public hearing regarding a manager application for
          Henry D. Sader II, in connection with a liquor license
          for the Lincoln Izaak Walton League in Bennet,
          Lancaster County, Nebraska.

5) NEW BUSINESS:

     A.   Resolution No. 5462, amending the 1997 through 2002
          Fiscal One and Six Year Lancaster County Road and
          Bridge Improvement Program, to add Project #C55-#98 to
          the One Year Plan to grade and rock South 112th Street
          beginning at Old Cheney Road and ending at Pioneers
          Boulevard, Lancaster County, Nebraska.

     B.   Recommendation from the Purchasing Agent and the County
          Sheriff to award a bid to L.T.R. Towing to provide
          towing and storage of towed vehicles, in the amount of
          $80 - $100,000.

     C.   Recommendation from the Purchasing Agent and the
          Lancaster County Engineer to award a bid to Petit
          Construction Company to provide grading construction
          for Yankee Hill Road for the County Engineer, in the
          amount of $134,056.57 for Part I and $32,098.50 for
          Part II.

     D.   Recommendation from the Purchasing Agent and the
          Lancaster County Engineer to award a bid to Land
          Construction Company, Inc. to provide and install
          culvert replacement and  maintenance for the County
          Engineer, in the amount of $55,634.34 for Part I and
          $16,924.76 for part II.

     E.   Recommendation from the Lancaster County Engineer to
          award a bid to Dobson Brothers Construction Company for
          the  construction of a Federal Aid Project beginning at
          the Southwest corner of Section 27, Township 9 North,
          Range 8 East and extends 7.0 miles North, terminating
          at the Northwest corner of Section 27, Township 10
          North, Range 8 East, Project #STPE-3365(5), in the
          amount of $1,039,585.77.

     F.   Recommendation from the Purchasing Agent and the
          Lancaster County Sheriff to award a bid for vehicles
          off the State of Nebraska Contract #CA-4834D to Park
          Place Chevrolet for two 1997 new Chevrolet Lumina 4-door
	  sedans, in the amount of $29,712.14.

     G.   Recommendation from the Purchasing Agent and the City
          of Lincoln to award a bid to All Makes Office Equipment
          for the Haworth full seating line and limited models
          from the Global managerial line; to Keo Office
          Furniture for the Eck Adams full seating line; and to
          Raders, Inc. for the Herman Miller full seating line
          from March 1, 1997 through February 28, 1998, with
          discounts ranging from 46% to 57% off the list pricing,
          based on volume incentives.

     H.   An Inter-governmental service agreement between the
          Lancaster County Corrections Department and the United
          States Marshal's Service for the housing, safekeeping
          and subsistence of federal prisoners at the rate of
          $61.23 per diem retroactive to July 1, 1995, with an
          estimated annual payment of $379,932.15.

     I.   Authorization for the installation of traffic signs in
          Lancaster County, Nebraska at the following location
          (Resolution No. 5461):

     J.   An agreement between Lancaster County and Johnson &
          Higgins for worker's compensation and general liability

          $10,000.

     K.   A contract between Lancaster Manor and Liberty
          Construction, Inc. to provide and install wallcovering
          at Lancaster Manor beginning March 4, 1997 through June
          30, 1997, in the amount of $15,709.42.

     L.   An agreement between Lancaster County and Farmers State
          Bank for providing subordination of the County's
          Economic Development Loan to Henderson Equine Clinic to
          the Trust Deed of Farmers State Bank, in the amount of
          $184,000.

     M.   A request from Brett Davis to place gravel on a portion
          of West Davey Road (Section 29, Township 12 North,
          Range 6 East).

6) CONSENT ITEMS:

     These are items of business before the Lancaster County
     Board of Commissioners which have been previously supplied
     to each Commissioner in writing, which are relatively
     routine and which are expected to be adopted without
     dissent.  Any individual items may be removed for special
     discussion and consideration by a Commissioner or by any
     member of the public without prior notice. Unless there is
     an exception, these items will be approved as one with a
     single vote of the Board of Commissioners.  These items are
     consideration of:

     A.   Monthly report for the Lancaster County Sheriff for
          January 1997.

     B.   Setting of a public hearing for March 11, 1997 at 1:30
          p.m. in the County Commissioners Hearing Room, First
          Floor, County- City Building, regarding the question of
          validating five warranty deeds, Instrument Nos. 95-10975,
          95-12179, 95-10976, 95-10977 and 95-12180,
          requested by Mr. Todd Lewis, grantee.

     C.   Setting of a public hearing for April 8, 1997 at 1:30
          p.m. in the County Commissioners Hearing Room, First
          Floor, County- City Building, regarding two
          applications for two Special Events Permits from the
          Nebraska Sports Council/Cornhusker State Games to hold
          cycling time trials and a road race on July 19, 1997
          from 9 a.m. to 5 p.m. and for a triathlon competition
          on July 20, 1997 at 7:30 a.m.

     D.   Resolution No. 5463, annual approval of the combined
          weed control program for the City of Lincoln as
          submitted by the Lancaster County Noxious Weed Control
          Superintendent.

     E.   An agreement between the Lancaster County Safety &
          Training Office and Carol M. Pagel for safety
          consultation services beginning March 4, 1997 through
          June 30, 1997 in the amount of $10,000.

     F.   User's agreement between Lancaster County and Raymond
          Poole for remote access to Lancaster County records at
          a rate of $.013 per transaction.

     G.   An agreement between the Attention Center for Youth and
          the University of Nebraska Medical Center, College of
          Nursing for psycho-educative classes 1-2 hours per week
          from March 3, 1997 through August 15, 1997, at a rate
          of $45 per hour.

     H.   An amendment to an agreement between the Lancaster
          County Community Mental Health Center and Region V for
          the provision of emergency protective care services
          from July 1, 1996 through June 30, 1997.

     I.   Contracts between the Lancaster County Engineering

               Pollution Control Program Regulations and
               Standards and to adopt recent federal standards,
               to correct errors and provide clarifying language.

          Campbell informed the Board she had received a
          telephone call from Mr. Sader asking if the Board had
          any questions and noted he would not be in attendance
          due to a schedule conflict.

          Steinman asked if anyone wished to appear in favor,
          opposition or in a neutral position.

          No one appeared.

          Steinman closed the public hearing with action to be
          taken on Tuesday, March 11, 1997.


5) NEW BUSINESS:

     A.   Resolution No. 5462, amending the 1997 through 2002

          Campbell said the item was bid previously and asked why
          it was rebid.

          Kathy Smith, Assistant Purchasing Agent, said the first
          bid was rejected because firm, fixed pricing was not
          received on the oversized vehicle towing.  She said
          when the item was rebid one vendor offered a "fair
          market price" and one vendor complied with the
          specifications.  The award recommendation was based on
          that information.

          MOTION:   Campbell moved and Svoboda seconded approval.
                    On call Campbell, Hudkins, Steinman and
                    Svoboda voted aye.  Motion carried.

     C.   Recommendation from the Purchasing Agent and the

     L.   An agreement between Lancaster County and Farmers State

          Kerry Eagan, Chief Administrative Officer, explained
          that a signed original agreement had not yet been
          received.  He recommended authorizing the Chair to sign
          the agreement when the original is received.

          Hudkins asked if the agreement would be subject to
          review by the County Attorney's office.

          Eagan responded yes.

          MOTION:   Hudkins moved and Campbell seconded approval
                    of authorizing the Chair to execute the
                    original agreement, subject to the County
                    Attorney's review. On call Campbell, Hudkins,
                    Steinman and Svoboda voted aye.  Motion
                    carried.

     M.   A request from Bret Davis to place gravel on a portion
          of West Davey Road (Section 29, Township 12 North,
          Range 6 East).

          Dana Baker, attorney representing Bret and Kim Davis
          and Dave and Sharon Friedeman, appeared and said the
          landowners are seeking to apply gravel to West Davey
          Road between Northwest 40th and Northwest 27th Streets.

          He said they are asking the Board to adopt a resolution
          which would allow the application of aggregate, at the
          landowners expense, to a portion of West Davey Road
          pursuant to a written contract with the County setting
          forth the rights and obligations of the parties.  Baker
          added the landowners would be allowed to apply the
          aggregate if the Board of Public Roads and
          Classification of Standards relaxes the standards for
          that portion of the road and determines that it doesn't
          render the rest of the road subject to minimum
          standards under the State Statutes.

          Baker also said the landowners would be willing to pay
          for the cost of signage which might be needed.

          Campbell said she was somewhat concerned about the
          liability that the County may be in jeopardy of and
          also of the precedence the Board would be setting in
          terms of other individuals putting material on a County
          road and the County still having the liability.  She
          asked if the County could be held harmless.

          Steinman asked if the County would be liable for the
          maintenance of the road if the landowners are allowed
          to apply aggregate.

          Doug Cyr, Deputy County Attorney, said the County would
          be responsible for maintaining the road after the
          aggregate.

          In response to Campbell's question, Cyr indicated he
          didn't see the tort issue as a huge issue and said the
          main issue raised in his written opinion was loss of
          funds Lancaster County could subject itself to as a
          result of approving the request without working with
          the Board of Public Road Classifications and Standards.

          Don Thomas, County Engineer, appeared and expressed his
          concerns regarding safety issues and the precedence
          which the County would be setting.

          Bret Davis, 2311 Southwest 12th Street, appeared and
          said he and the Friedemans would be willing to pay for
          the aggregate and signage the Board or the County
          Engineer deemed necessary.

          Campbell asked if it was possible for the landowners to
          meet and develop a plan which the Board would agree to.

          Cyr stated there are procedures set forth in the
          statutes to deal with a type of situation where the
          County doesn't have the current funds to expend for a
          road improvement being sought by landowners.  These
          procedures would be creation of a special improvement
          district or a rural road improvement district.

          Cyr recommended deferring action for one week,
          discussing the item on Thursday, March 6, 1997 with
          placement back on the agenda for Tuesday, March 11,
          1997.

          Dave Friedeman, landowner, indicated they had talked
          with the other landowners and tried to come up with an
          agreement, however, it hadn't worked.

          MOTION:   Hudkins moved and Svoboda seconded to accept
                    the County Attorney's recommendation to defer
                    action for one week with discussion of the
                    request on Thursday, March 6, 1997 and
                    placement back on the agenda for Tuesday,
                    March 11, 1997.  On call Campbell, Hudkins,
                    Steinman and Svoboda voted aye.  Motion
                    carried.

          applications for two Special Events Permits from the
          Nebraska Sports Council/Cornhusker State Games to hold
          cycling time trials and a road race on July 19, 1997
          from 9 a.m. to 5 p.m. and for a triathlon competition
          on July 20, 1997 at 7:30 a.m.

     D.   Resolution No. 5463, annual approval of the combined
          weed control program for the City of Lincoln as
          submitted by the Lancaster County Noxious Weed Control
          Superintendent.

     E.   An agreement between the Lancaster County Safety &
          Training Office and Carol M. Pagel for safety
          consultation services beginning March 4, 1997 through
          June 30, 1997 in the amount of $1,000.

     F.   User's agreement between Lancaster County and Raymond
          Poole for remote access to Lancaster County records at
          a rate of $.013 per transaction.

     G.   An agreement between the Attention Center for Youth and
          the University of Nebraska Medical Center, College of
          Nursing for psycho-educative classes 1-2 hours per week
          from March 3, 1997 through August 15, 1997, at a rate
          of $45 per hour.

     F.   User's agreement between Lancaster County and Raymond
          Poole for remote access to Lancaster County records at
          a rate of $.013 per transaction.

     G.   An agreement between the Attention Center for Youth and
          the University of Nebraska Medical Center, College of
          Nursing for psycho-educative classes 1-2 hours per week

     H.   An amendment to an agreement between the Lancaster
          County Community Mental Health Center and Region V for

     holding a public information session on Wednesday, March 12,
     1997 at 7 p.m. at Norris High School regarding the proposed
     work by Burlington Northern Railroad directly north of
     Firth, Nebraska.

1) MINUTES:

     Approval of the minutes of the Board of Equalization meeting
     held on Tuesday, February 25, 1997. (A copy of these minutes
     is on file in the Office of the Lancaster County Clerk.)

     MOTION:   Hudkins moved and Svoboda seconded approval.  On
               call Hudkins, Steinman and Svoboda voted aye.
               Motion carried.

2) ADDITIONS AND DEDUCTIONS:

     Approval of 168 additions and deductions to the tax
     assessment rolls as per Exhibit "A" and "B".

     MOTION:   Hudkins moved and Svoboda seconded approval.  On
               call Steinman, Svoboda and Hudkins voted aye.
               Motion carried.


3) MOTOR VEHICLE TAX EXEMPTIONS:

     Nebraska Wesleyan University

     MOTION:   Hudkins moved and Svoboda seconded approval.  On
               call Svoboda, Hudkins and Steinman voted aye.
               Motion carried.


4) 451 AND 451A EXEMPTION APPLICATIONS:

     Approval of 451 & 451A Tax Exemption Applications on
     Personal Property and Real Estate as per Exhibit "C".

     MOTION:   Svoboda moved and Hudkins seconded approval.  On
               call Hudkins, Steinman and Svoboda voted aye.
               Motion carried.
