1.) MINUTES: Approval of the minutes of the Board of Commissioners meeting held on Tuesday, February 11, 1997. (A copy of these minutes is on file in the Office of the Lancaster County Clerk.) 2.) CLAIMS: Approval of all claims processed through Tuesday, February 18, 1997, with the exception that the vote of any Commissioner who might have a conflict of interest in the payment of any claim shall be deemed an abstention from approval for such claims alone. 3.) ITEMS OF PUBLIC PARTICIPATION: It is the policy of the Lancaster County Board of Commissioners to accommodate the public to the greatest extent possible. Therefore, this agenda has been prepared with items of greatest public interest at the beginning, with more routine items toward the end as a courtesy to those who wish to speak with the County Board at this meeting. County Change of Zone No. 168, text amendment to Article 2 and Article 4 of the County Zoning Resolution, requested by Timothy Moore for James Arthur Vineyards, to define and conditionally permit "farm wineries" as a conditional use in the Ag Agricultural Zoning District. 5.) NEW BUSINESS: A. Appointment of Lynette Nelson to the Lincoln-Lancaster County Ecological Advisory Committee. B. Renewal of an amusement license for the Nebraska State Board of Agriculture to operate the Nebraska State Fair, Horse-Car-Motorcycle Racing, Simulcasting, Ice Skating and other sports and entertainment events at the State Fair Park in Lancaster County, Nebraska. C. An addendum to an agreement between Lancaster County and Lincoln General Hospital to provide twenty hours of nursing services per week at the Lancaster County Community Mental Health Center's outpatient clinic at the rate of $25 per hour beginning February 3, 1997. D. A rental agreement between Lancaster County and Diana Owens, Owens Educational Services, for Room 401, located in Trabert Hall, 2202 South 11th Street, at the rate of $394 per month beginning February 1, 1997. E. A recommendation from the Purchasing Agent and the Superintendent of Noxious Weed Control Authority to award a bid to provide weed control services for the Noxious Weed Control Authority to the following at rates specified in the bids: A.A. CONSENT ITEMS: These are items of business before the Lancaster County Board of Commissioners which have been previously supplied to each Commissioner in writing, which are relatively routine and which are expected to be adopted without dissent. Steinman asked if anyone wished to appear in opposition to the change of zone request. No one appeared. Steinman asked if anyone wished to appear in a neutral position. No one appeared. Steinman closed the public hearing. MOTION: Svoboda moved and Tussing seconded approval of County Change of Zone No. 168. On call Svoboda, Tussing, Hudkins and Steinman voted aye. Motion carried. 5.) EMERGENCY ITEMS AND OTHER BUSINESS: Wayne Gi ebelhaus, 4000 S. Folsom, appeared regarding the proposed site plan for the Optimist Youth Sports Complex located at Folsom and W. Pioneers Boulevard. He reported that residents had appealed the special permit and that voting on the issue is scheduled for March 3rd before the Lincoln City Council. Lareta Harms, 4501 S. Folsom, appeared and displayed a map of the proposed site and the surrounding area. Giebelhaus reported that residents had the following concerns regarding the proposed complex: 1. Late Hours of Operation and Daily Use of the Complex 2. Lighting and Noise Conditions 3. Water Service and Quality 4. Sewage System 5. Traffic Conditions and Safety 6. Lack of Traffic Outlets 7. Need for Speed Reduction on Folsom Street Giebelhaus distributed copies of a letter to Rich Wright, Young Men's Christian Association (YMCA), from the Building and Safety Department regarding noncompliance with the special permit conditions at Wright Field, W. Pioneer Boulevard and S. Folsom Streets (Exhibit A) and copies of a memo from Public Works and Utilities to the Planning Department noting drainage, sewer and water service and traffic concerns with regards to the Optimist Youth Sports Complex (Exhibit B). Giebelhaus also read excerpts of a letter he had received from Governor Nelson regarding the issue. Steinman suggested scheduling further discussion of the matter with the County Engineer at a Thursday County Board meeting. Giebelhaus also expressed concern regarding the lack of a "junked car" ordinance within the three mile limit. Diane Staab, Deputy County Attorney, stated that the Board had discussed attaching a "junked car" ordinance to a zoning ordinance, but noted that the County does not have zoning jurisdiction within the three mile limit. Doris Sidell, 5201 S. Folsom, appeared to state concern regarding the effect the increased traffic would have on property valuations. MOTION: Tussing moved and Svoboda seconded to enter Executive Session at 3:05 p.m. to discuss pending litigation. On call Svoboda, Tussing, Hudkins and Steinman voted aye. Motion carried.
