1) MINUTES: Approval of the minutes of the Board of Commissioners meeting held on Tuesday, January 28, 1997. (A copy of these minutes is on file in the Office of the Lancaster County Clerk.) 2) CLAIMS: Approval of all claims processed through Tuesday, February 4, 1997, with the exception that the vote of any Commissioner who might have a conflict of interest in the payment of any claim shall be deemed an abstention from approval for such claims alone. 3) ITEMS OF PUBLIC PARTICIPATION: It is the policy of the Lancaster County Board of Commissioners to accommodate the public to the greatest extent possible. Therefore, this agenda has been prepared with items of greatest public interest at the beginning with more routine items toward the end as a courtesy to those who wish to speak with the County Board at this meeting. If you are here to participate on an item and need special consideration because of schedule conflict or some other problem, would you please let us know now so we can try to meet your needs. * Update of the County Roadside Dumping Education Program - Harry Heafer, Health Department 4) PUBLIC HEARINGS: Adoption of an Interlocal Agreement between Lancaster County and the City of Lincoln for building inspection and permitting services; adoption of fee schedules for mechanical, gas piping, electrical, plumbing, building, plan review, insulation and zoning review in the County (Resolution Number 5434); adoption of the 1994 edition of the Uniform Mechanical Code (Resolution Number 5430); adoption of the 1994 edition of the Uniform Building Code (Resolution No. 5431) and the adoption of the 1996 edition of the Electrical Code (Resolution Number 5432). 5) NEW BUSINESS: A. Refund of motor vehicle taxes for Peg Hartgerink for $31 because the vehicle was taxed in the incorrect taxing district. B. Appointments of the following to the Lincoln-Lancaster Women's Commission: NAME EXPIRATION OF TERM Annette M. McRoy January 1, 1998 Stephanie Ortiz-Cidlik January 1, 2000 C. Appointment and reappointment of the following to the Lincoln-Lancaster County Ecological Advisory Committee: NAME EXPIRATION OF TERM Michael Fritz (reappointment) January, 2000 Daniel Ludwig (new appointment) January, 2000 D. A salary increase for Dennis Banks from $39,156 to $40,722 while serving as the interim Attention Center Director, retroactive to December 19, 1996. E. Designation and recognition of computer generated zoning maps as the official Lancaster County Zoning District Maps (Resolution Number 5433). F. Agreements between the Lancaster County Attention Center for Youth and Saline, Saunders and Seward counties to assume the safekeeping, care and sustenance of persons held as detainees at a rate of $176.82 per day, or at partial rates for six hour increments as specified in the agreements, effective upon execution by both parties. G. An agreement between the Lancaster County Engineering Department and Norris Public Power District for construction work on Pleasant Hill Road from Stable Lane to Southwest 12th Street for the total amount of $18,878.32 of which $5,663.50 is the estimated cost to the County. 6) CONSENT ITEMS: These are items of business before the Lancaster County Board of Commissioners which have been previously supplied to each Commissioner in writing, which are relatively routine and which are expected to be adopted without dissent. Any individual item may be removed for special discussion and consideration by a Commissioner or by any member of the public without prior notice. Unless there is an exception, these items will be approved as one with a single vote of the Board of Commissioners. These items are consideration of: A. Placing on file of the 1997 Aliant Communications maps showing the routing of buried telephone cable in Lancaster County. B. A quarterly report from the Lancaster County Veterans' Service Center. C. A maintenance agreement between the Lancaster County Sheriff's Office and Carmichael Business Systems, for $251.66, commencing on February 17, 1997 and ending February 17, 1998. D. An agreement between Lancaster County and the Association of Students of the University of Nebraska for use of the County's election equipment and election services for $512, effective upon execution by both parties until April 15, 1997. E. A service agreement between Lancaster Manor and Aliant Communications for equipment, in the amount of $3,465, commencing September 22, 1996 and ending September 21, 1997. F. The Lancaster County Board of Commissioners will not hold a meeting on Thursday, February 6, 1997 instead they will hold a meeting on Tuesday, February 4, 1997 at 12 p.m. in the Fourth Floor Conference Room, County-City Building. B. The Lancaster County Board of Commissioners Mid-Year Budget Review Retreat, previously scheduled for Wednesday, January 22, 1997 at the Cornhusker Hotel, located at 333 South 13th Street, has been rescheduled for Wednesday, February 5, 1997 from 8 a.m. to 4 p.m. at the same location. C. A public hearing will be held on Tuesday, February 11, 1997, at 1:30 p.m. in the Commissioners Hearing Room, First Floor, County-City Building for a variance of lot area from 20 acres to 3.74 acres and a variance of frontage and minimum lot width from 550 feet to 300 feet, requested by William Blake on behalf of John Divine, on property located east of Northwest 84th Street and West Branched Oak Road in Lancaster County, Nebraska (County Board of Zoning Appeals, Appeal Number 103). D. A public hearing will be held on Tuesday, February 18, 1997, at 1:30 p.m. in the Commissioners Hearing Room, First Floor, County-City Building for a text amendment to the County Zoning Resolution, requested by Timothy Moore for James Arthur Vineyards, to define and conditionally permit "farm wineries" as a conditional use in the AG Agricultural District (County Change of Zone Number 168). E. MOTION: Tussing moved and Hudkins seconded to add the recognition of February 3 through 9, 1997 as National Girls and Women in Sports Week to the agenda (Resolution Number 5435). On call Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye. Motion carried. Bonnie Coffey, Executive Director of the Lincoln-Lancaster Women's Commission, appeared and gave a brief explanation of National Girls and Women in Sports Week. The Clerk read Resolution Number 5435 into the record. MOTION: Hudkins moved and Campbell seconded approval of the adoption of Resolution Number 5435. On call Steinman, Svoboda, Tussing, Campbell and Hudkins voted aye. Chuck Zimmerman, Building and Safety Department, appeared and said language was being updated in the interlocal agreement. He added resolutions are also included to update codes and simplify the fee structure and fee system and gave a brief explanation of each. Steinman asked if anyone wished to speak in favor, opposition or in a neutral position. No one appeared. Steinman closed the public hearing. MOTION: Campbell moved and Hudkins seconded approval of Resolution Number 5434 (fee schedule). On call Svoboda, Tussing, Campbell, Hudkins and Steinman voted aye. Motion carried.
