Schmuecker Supreme Court Decision

Today, the Nebraska Supreme Court issued it's ruling and opinion in the appeal of Schmuecker v Lancaster County. This case stemmed from former Lancaster County Sheriff's Sgt. Ryan Schmuecker's employment being terminated by Sheriff Terry Wagner following an Internal Affairs investigation into Schmuecker's failure to serve an arrest warrant on February 18, 2024.
Schmuecker appealed the termination to the Lancaster County Sheriff's Office Merit Commission, which upheld Sheriff Wagner's decision. He then appealed to Lancaster County District Court, which upheld the Merit Commission's ruling. The District Court's ruling was subsequently appealed to the Nebraska Supreme Court who ultimately affirmed the decision.
Sheriff Wagner said, "I am pleased three separate judicial reviews upheld my decision to terminate Schmuecker's employment. The Courts have affirmed that the Sheriff's Office disciplinary process is legal and appropriate, and that when the law says a law enforcement officer shall arrest on a warrant, the officer cannot decide whether or not to comply with the law."
